PROCEEDINGS OF THE MEETING OF THE MAYOR AND BOARD OF ALDERMEN OF THE CITY OF BREAUX BRIDGE HELD AT THE CITY HALL, 101 BERARD STREET, AT 6:00 P.M. ON TUESDAY, JULY 12, 2016.

 

Mayor Ricky Calais called the meeting to order, the Invocation and Pledge of Allegiance was recited.

 

Present:  Brenda Castille Hobbs, Ernest “E.J.” Ledet, Howard Alexander, Glenn Michael Angelle and Gary Champagne

 

Absent: None

 

Upon Motion of Glenn Michael Angelle, duly seconded by Howard Alexander and unanimously carried, the Board of Aldermen approved to add and delete the following items to the agenda:

 

Item #12: Approval of Police Chief Cantu to hire a new patrol officer

 

Delete item #9: Consider request by Park Plaza, LLC. to be allowed to accommodate T.M. Landry College Preparatory School at their 908 Rees Street location- Mayor Calais

 

Upon motion of Gary Champagne, duly seconded by Howard Alexander and unanimously carried, the Board of Aldermen approved the minutes of the Regular Meeting held on June 14, 2016, as well as the minutes of the Special Meeting held on June 23, 2016.

 

Upon motion of Glenn Michael Angelle, duly seconded by Howard Alexander and unanimously carried, the Board of Aldermen approved the recommendation of Chief Cantu to hire Gene Mazell II as a patrol officer for the Breaux Bridge Police Department.

 

Upon motion of Howard Alexander, duly seconded by Glenn Michael Angelle and unanimously carried, the Board of Aldermen opened a public hearing on Ordinance 2221 (An Ordinance to dispose of the house located at 329 Berard Street Breaux Bridge, Louisiana, 70517 (the “House”) to allow for the widening of Dorset Street, and providing for other matters in connection therewith).

 

Upon motion of Gary Champagne, duly seconded by Brenda Castille Hobbs, and unanimously carried, there being no public input, the Board of Aldermen voted to close the public hearing of Ordinance 2221.

 

Upon motion of Glenn Michael Angelle, duly seconded by Howard Alexander and unanimously carried, Ordinance 2221 (An ordinance to dispose of the house located at 329 Berard Street, Breaux Bridge, Louisiana 70517 (the “House”) to allow for the widening of Dorset Street, and providing for other matters in connection therewith) was adopted.

 

 

ORDINANCE NUMBER 2221

An ordinance to dispose of the house located at 329 Berard Street, Breaux Bridge, Louisiana 70517 (the “House”) to allow for the widening of Dorset Street, and providing for other matters in connection therewith.

WHEREAS, the City of Breaux Bridge (the “City”) purchased the House and lot (“the Lot”) located at 329 Berard Street, Breaux Bridge, Louisiana 70517 with the intention to utilize the Lot for the widening of Dorset Street (the “Project”);

WHEREAS, the City obtained an appraisal of the House by Angelle Appraisal Service, Inc., whereby the value of House was determined to be Seventeen Thousand and No/100 ($17,000) Dollars;

WHEREAS, the City has determined that the House must be removed from the Lot for the City to complete the Project;

WHEREAS, the City has obtained quotes for the removal and relocation of the House, and the estimated cost to complete the removal and relocation of the House from the Lot is as follows:

  1. Scott’s House Moving and Leveling, LLC: Cost to move

and level House at new location                                                  $11,880.00

  1. Scott’s House Moving and Leveling, LLC: Cost of materials

to move House                                                                                $978.45

  1. Ocmond Construction Co., LLC: Cost to remove and replace

roof for moving                                                                               $17, 670.00

  1. Hebert’s Tree & Stump Removal, LLC: Cost to remove

tree necessary to relocate House                                                  $650.00

TOTAL                   $31,178.45

WHEREAS, the aforementioned estimated cost to remove and relocate the House does not include any additional costs the City would incur to store the House once removed from the Lot;

WHEREAS, Louisiana R.S. 33:4712 authorizes a municipality to dispose of any property not needed for a public purpose;

WHEREAS, the Mayor and the Board of Aldermen have determined that the House does not serve any public purpose and must be removed to complete the Project;

WHEREAS, in accordance with the dictates of Louisiana R.S. 33:4712 (B), an ordinance must be introduced by the City before a municipality may dispose of property no longer needed for a public purpose;

BE IT, THEREFORE, ORDAINED by the Board of Aldermen for the City of Breaux Bridge, Louisiana, that the House located 329 Berard Street, Breaux Bridge, Louisiana 70517 shall be disposed of for the purpose of widening Dorset Street.

BE IT FURTHER ORDAINED that the disposal of the House shall be for the best price and terms offered to the City, but in no event shall the cost of disposal be in excess of Fourteen Thousand One Hundred Seventy-Eight and 45/100 ($14,178.45) Dollars (Representing the difference between the appraised value of the House and the estimated cost to remove and relocate same).

 

BE IT FURTHER ORDAINED that in accordance with Louisiana R.S. 33:4712 (B), notice of this proposed Ordinance shall be published three (3) times in fifteen (15) days, one week apart, in a newspaper having a general circulation in the City.

BE IT FURTHER ORDAINED that any opposition to this proposed Ordinance shall be made in writing, filed with the Clerk of the City of Breaux Bridge within fifteen (15) days after the first publication of the aforementioned notice.

BE IT FURTHER ORDAINED that if any opposition to this proposed Ordinance is timely and properly filed, the City shall not adopt this Ordinance until a hearing has been held; and further, this Ordinance shall not become effective until all delays and requirements of law are satisfied.

BE IT FURTHER ORDAINED that the provisions of this Ordinance are hereby declared to be severable, and if any provision, word phrase, or clause of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect the validity of the remaining portions thereof;

BE IT FURTHER ORDAINED that this Ordinance, if adopted, and in accordance with Louisiana R.S. 33:4712 (C), shall become effective ten (10) days after the signature of the Mayor and Clerk of the City of Breaux Bridge, Louisiana.

BE IT FURTHER ORDAINED that once this Ordinance becomes effective, the Mayor for the City of Breaux Bridge, Louisiana, be and is hereby authorized, directed, and empowered to enter into any and all contracts and execute any and all documents which may be necessary to effectuate the above and foregoing edicts.

July, 2016, the vote thereon was follows:

Upon motion of Gary Champagne, duly seconded by Howard Alexander and unanimously carried, the Board of Aldermen reappointed Mr. Lennett Guidry to the Civil Service Board.

The following comment was given by Alderman Brenda Castille Hobbs:

“I want us to take into consideration that our police force is composed of 19 males and 13 females as of today and so perhaps in the future we could ask that one of these appointees as they come up for reappointment, maybe we could start looking at trying to get a female on that board.”

 

 

Sales tax for the month of May collected in June 2016 was $258,845.19.
