PROCEEDINGS OF THE MEETING OF THE MAYOR AND BOARD OF ALDERMEN OF THE CITY OF BREAUX BRIDGE HELD AT THE CITY HALL, 101 BERARD STREET, AT 6:00 P.M. ON TUESDAY, MAY 9, 2017.

Mayor Ricky Calais called the meeting to order, the Invocation and Pledge of Allegiance was recited.

 

Present:  Brenda Castille Hobbs, Ernest Ledet, Glenn Michael Angelle and Gary Champagne

 

Absent:  Howard Alexander

 

Upon motion of Glenn Michael Angelle duly seconded by Brenda Castille Hobbs and unanimously carried, the Board of Aldermen approved to add the following item to the agenda:

 

Item #14-Acceptance of North Bridge Drainage Project from C-Core.

 

Upon motion of Gary Champagne duly seconded by Glenn Michael Angelle and unanimously carried the minutes of the April 11, 2017 meeting was approved.

 

Upon motion of Glenn Michael Angelle duly seconded by Gary Champagne and unanimously carried, the public hearing to discuss the Property Millage Rates was opened for public input.

 

Someone from the audience asked if it was a new rate.

 

Mayor Calais explained that it was just a renewal and they have not been increased since it was installed and placed by the legislature in 1973.  He explained the fact that we probably

should increase the rates because of the budget.  He stated that if you looked at the budget you

would realize we could use an increase.  He explained the process of increasing the millage rate

and why it should be increased.  The only time you wouldn’t increase would be because you had

all the money you need to take care of the people in the community and we are not even close

to that.  No one can say they are over taxed by the City of Breaux Bridge, maybe by other

entities but not by the City of Breaux Bridge.

 

 

Upon motion of Gary Champagne and duly seconded by Glenn Michael Angelle and unanimously carried, there being no further input, the hearing was closed.

 

Upon motion of Glenn Michael Angelle duly seconded by Gary Champagne and unanimously carried, the Millage Rates were adopted.

 

CITY OF BREAUX BRIDGE

RESOLUTION

 

BE IT RESOLVED, that the following millage(s) are hereby levied on the 2017 tax roll on all property subject to taxation by the City of Breaux Bridge.

 

MILLAGE

 

General Alimony                                                                                              4.490 mills

 

BE IT FURTHER RESOLVED that the proper administrative officials of the Parish of St. Martin, State of Louisiana, be and they are hereby empowered, authorized, and directed to spread said taxes, as hereinabove set forth, upon the assessment roll of said Parish for the year 2017, and to make the collection of the taxes imposed for and on behalf of the taxing authority, according to law, and that the taxes herein levied shall become a permanent lien and privilege on all property subject to taxation as herein set forth, and collection thereof shall be enforceable in the manner provided by law.

 

The foregoing resolution was read in full, the roll was called on the adoption thereof, and the resolution was adopted by the following votes:

NAYS:  None

 

ABSTAINED:         None

Upon motion of Glenn Michael Angelle duly seconded by Brenda Castille Hobbs and unanimously carried, Ordinance #2228 (AN ORDINANCE CREATING SALES TAX DISTRICT NO. 2 OF THE CITY OF BREAUX BRIDGE, STATE OF LOUISIANA; AND PROVIDING FOR OTHER MATTERS IN CONNECTION THEREWITH.) was tabled.

 

Upon motion of Glenn Michael Angelle duly seconded by Brenda Castille Hobbs and unanimously carried, Ordinance #2229 (AN ORDINANCE LEVYING AN ADDITIONAL SALES AND USE TAX OF ONE PERCENT (1%) IN SALES TAX DISTRICT NO. 2 OF THE CITY OF BREAUX BRIDGE, STATE OF LOUISIANA; IN THE MANNER AND FOR THE PURPOSES AS SET FORTH UNDER THAT CERTAIN INTERGOVERNMENTAL AGREEMENT BETWEEN THE CITY AND THE DISTRICT AND IN ACCORDANCE WITH THE PROVISIONS OF LA R.S. 47:338.1., AND CERTAIN OTHER RELATED MATTERS.) was tabled.

 

 

Upon motion of Glenn Michael Angelle duly seconded by Brenda Castille Hobbs and unanimously carried the following Resolution authorized Mayor Ricky Calais  to enter into a servitude agreement with CLECO at Veteran’s Park for the relocations of Utility lines, provided that they are run underground.

RESOLUTION

            WHEREAS, a renovation project is in progress relative to the aforesaid premises, all related to the renovation of the Veteran’s Park located on Berard Street, in Breaux Bridge, Louisiana;

WHEREAS, it is necessary that the aforesaid project be serviced by electric distribution facilities;

WHEREAS, CLECO Power LLC, has requested that the City of Breaux Bridge, Louisiana, grant unto it servitude of passage over property owned by the City of Breaux Bridge, Louisiana, situated adjacent to the premises currently being renovated pursuant to Ordinance Number 2220.

THIS RESOLUTION having been submitted to a vote, the result was as follows:

YEAS: Brenda Castille Hobbs, Ernest Ledet, Glenn Michael Angelle and Gary          Champagne

NAYS: None 

ABSENT: Howard Alexander

ABSTAIN: None

AND THIS RESOLUTION was declared adopted on the 9th day of May, 2017.

Upon motion of Gary Champagne duly seconded by Glenn Michael Angelle and unanimously carried, Ordinance #2230 (BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF BREAUX BRIDGE, LOUISIANA THAT THE MUNICIPAL BUDGET FOR FISCAL YEAR ENDING JUNE 30, 2017 BE AMENDED ACCORDING TO THE TERMS AND FIGURES CONTAINED IN THE ATTACHED EXHIBIT IDENTIFIED AS “EXHIBIT A”.) was introduced.

 

Upon motion of Gary Champagne duly seconded by Glenn Michael Angelle and unanimously carried, Ordinance #2231 (BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF BREAUX BRIDGE, LOUISIANA THAT THE MUNICIPAL BUDGET FOR FISCAL YEAR ENDING JUNE 30, 2018 BE ADOPTED ACCORDING TO THE TERMS AND FIGURES CONTAINED IN THE ATTACHED EXHIBIT IDENTIFIED AS “EXHIBIT A”.) was introduced.

 

Upon motion of Gary Champagne duly seconded by Glenn Michael Angelle and unanimously carried, the Board of Aldermen accepted the North Bridge drainage project from C-Core, Inc.

 

RESOLUTION OF ACCEPTANCE

A resolution authorizing and directing the Mayor to execute for and on behalf of the City of Breaux Bridge, Louisiana an Act of Acceptance from C-Core, Inc., of Rayne, LA, Contractor, pertaining to the completion of the North Bridge Pond Drainage Swale for the City of Breaux Bridge, LA.

WHEREAS, C-Core, Inc., as Contractor, has substantially completed the North Bridge Pond Drainage Swale for the City of Breaux Bridge, Louisiana, in accordance with the plans and specifications contained in the Contract Documents pertaining thereto; and

WHEREAS, the City of Breaux Bridge, Louisiana acting through its Mayor and Councilmen, desires to accept the completed work;

NOW, THEREFORE, IT BE RESOLVED by the Councilmen of the City of Breaux Bridge, Louisiana, acting as the governing authority for the said City of Breaux Bridge, that the Mayor, be and he is hereby empowered, authorized and directed to execute an Act of Acceptance for and on behalf of the City of Breaux Bridge, Louisiana, accepting the work as being complete, and that he be authorized and directed to have a copy of said Acceptance recorded in the Conveyance Records of the Parish of St. Martin, State of Louisiana.

The foregoing resolution was offered by Gary Champagne and

seconded by Glenn Michael Angelle.

This resolution having been submitted to a vote, the vote thereon was as follows:

YEAS:  Brenda Castille Hobbs, Ernest Ledet, Glenn Michael Angelle and Gary Champagne

NAYS: None

ABSENT: Howard Alexander

AND the resolution was declared adopted on this the 9th day of May

2017.

NOTICE OF ACCEPTANCE

TO ALL WHOM IT MAY CONCERN, and especially to all subcontractors, workmen, laborers, mechanics, and furnishers of materials:

Public Notice is hereby given according to law that the undersigned Owner has accepted, as substantially complete, the work done on the North Bridge Pond Drainage Swale Project by C-Core, Inc., Contractor, under his contract with the City of Breaux Bridge, Louisiana, dated March 3, 2017, and recorded under Inst. No. 507035 in the Records of the Clerk of Court, Parish of St. Martin, Louisiana;

All subcontractors, workmen, laborers, mechanics, and furnishers of materials must assert whatever claim they may have against the said Contractor, growing out of the execution of said Contract, according to law, within 45 days from registration hereof.
