PROCEEDINGS OF THE MEETING OF THE MAYOR AND BOARD OF ALDERMEN OF THE CITY OF BREAUX BRIDGE HELD AT THE CITY HALL, 101 BERARD STREET, AT 6:00 P.M. ON WEDNESDAY, NOVEMBER 9, 2016.

 

Mayor Ricky Calais called the meeting to order, the Invocation and Pledge of Allegiance were recited.

 

Present:  Brenda Castille Hobbs, Ernest “E.J.” Ledet, Howard Alexander, Glenn Michael Angelle

and Gary Champagne

 

Absent:  None

 

Upon motion of Howard Alexander, duly seconded by Glenn Michael Angelle and unanimously carried, the Board of Aldermen approved to delete Item #10 (Consider approving of Rights-of-Way on the Fred Mills property along Rees Street) and added Item #17 (Discussion of Parish Bond.)

 

Upon motion of Ernest “E.J.” Ledet, duly seconded by Glenn Michael Angelle and unanimously carried, the Board of Aldermen approved the minutes of the regular council meeting held October 11, 2016 and minutes of the special meeting held October 25, 2016.

 

Sales Tax for the month of September 2016 collected in October 2016 $256,651.92

 

Upon motion of Gary Champagne, duly seconded by Howard Alexander and unanimously carried, the Board of Aldermen approved supporting the rededication of the Bond Issue for St. Martin Parish.

 

Upon motion of Howard Alexander, duly seconded by Glenn Michael Angelle and unanimously carried, the Board of Aldermen authorized (subject to the approval and acceptance of City Engineer, Chris Richard and Mayor Calais) the abandonment of the old servitude and to reestablish a new servitude for the water, sewer and sewer lift pump station located on the old Fred Mills property (119 Rees Street).

 

Upon motion of Howard Alexander, duly seconded by Brenda Castille Hobbs and unanimously carried, the Mayor and Board of Aldermen approved the Acadiana Broadband Agreement.

 

Upon motion of Howard Alexander, duly seconded by Glenn Michael Angelle and carried by roll call vote the approval of the following Resolution to support Legislation to authorize the Police Chief to appoint, discipline, and discharge police personnel and related matters without approval of Board of Aldermen.

CITY OF BREAUX BRIDGE

RESOLUTION

A RESOLUTION TO SUPPORT LEGISLATION TO AUTHORIZE THE POLICE CHIEF TO APPOINT, DISCIPLINE, AND DISCHARGE POLICE PERSONNEL AND RELATED MATTERS WITHOUT APPROVAL OF BOARD OF ALDERMAN

WHEREAS, La R.S. 33:423 provides that, in municipalities governed by a mayor and board of aldermen form of government, the elected chief of police must make recommendations to the mayor and board of alderman for the appointment of police personnel, for the promotion of officers, to effect disciplinary action, and for dismissal of police personnel, and that the mayor and board of alderman shall make final determination on such matters; and

WHEREAS, the Mayor and Board of Aldermen of the City of Breaux Bridge now desire to relinquish unto the Chief of Police of the City of Breaux Bridge, all those powers outlined under the provisions of La. R.S. 33:423, including, but not limited to , the power to appoint, promote, discipline and discharge police personnel; and

WHEREAS, the Mayor and Board of Aldermen of the City of Breaux Bridge support the adoption of legislation transferring all those powers outlined under La. R.S. 33:423 from the Mayor and Board of Aldermen to the Chief of Police; and

WHEREAS, the Board of Aldermen of the City of Breaux Bridge further desire that the Chief of Police of the City of Breaux Bridge be granted the authority to determine the duties of the Assistant Chief of Police, and, that the Assistant Chief of Police be authorized to act as Chief of Police in the administration of the Police Department in the absence of the Police Chief; and support legislation that would grant the Chief of Police such authority; and

WHEREAS, on this 9th day of November, 2016, the Board of Aldermen of the City of Breaux Bridge, Louisiana did meet in open and regular session in order to consider this Resolution; and

NOW THEREFORE BE IT RESOLVED that the Board of Aldermen of the City of Breaux Bridge authorizes and directs Mayor Ricky J. Calais and/or Police Chief Rollie Cantu, to request the assistance from the local delegation of Louisiana state legislators, namely Senator Fred Mills, Senator Gerald Boudreaux, Representative Mike Huval and/or Representative Terry Landry, to promote and pursue legislation to provide for an additional section under La. R.S. 33:432, to be presented at the next Regular Legislative Session for the State of Louisiana, to read as follows:

City of Breaux Bridge; authority over police personnel by Chief of Police; Assistant Police Chief duties

  1. Notwithstanding the provisions of R.S. 33:423 or any other provision of law to the contrary, in and for the City of Breaux Bridge, the Chief of Police shall appoint, discipline, and discharge police personnel subject to the budgetary limitations established by the Mayor and Board of Aldermen for the Police Department.
  2. Notwithstanding the provisions of any law to the contrary, the duties of the Assistant Chief of Police of the City of Breaux Bridge shall be determined by the Chief of Police for the municipality, and the Assistant Chief shall act as chief in the administration of the Police Department in the absence of the Police Chief.

This Resolution shall become effective immediately upon it adoption.

By motion of Aldermen Howard Alexander, duly seconded by Aldermen Glenn Michael Angelle, the above Resolution as adopted by the following vote on this 9th day of November, 2016.

Upon motion of Glenn Michael Angelle, duly seconded by Howard Alexander and unanimously carried the public hearing on Ordinance # 2224 (An ordinance to amend Chapter 20, Article II, Division 4 of the Code of Ordinances for the City of Breaux Bridge, Louisiana, by the enactment of Section 20-81 through 20-81.5, relative to peddlers and those engaged in the peddling of goods within city limits.) was opened for public input.

 

Upon motion of Brenda Castille Hobbs, duly seconded by Gary Champagne and unanimously carried being there was no public input the hearing on Ordinance #2224 was closed.

 

Public hearing on proposed Ordinance #2224, being considered for final adoption will be held on December 13, 2016 at 6:00 P.M. at the Breaux Bridge City Hall, 101 Berard Street, Breaux Bridge Louisiana.

 

Upon motion of Glenn Michael Angelle, duly seconded by Howard Alexander and unanimously carried  the Board of Aldermen approved the Introduction of Ordinance #2225 (An ordinance authorizing the issuance by the City of Breaux Bridge, State of Louisiana of its Taxable Utilities Revenue Bonds, Series 2017, in an amount not to exceed Eight Million Dollars ($8,000,000), prescribing the form, terms and conditions of said Bonds; providing for the payment thereof; entering into certain other covenants and agreements in connection with the security and payment of said Bonds; selling said Bonds to the Clean Water State Revolving Fund; authorizing the execution of a Loan and Pledge Agreement and other loan documents with the Louisiana Department of Environmental Quality; providing for the delivery of the Bonds to said Department; and providing for other matters in connection therewith.  Public hearing to be held on proposed Ordinance #2225, being considered for final adoption by the City of Breaux Bridge on December 13, 2016 at 6:00 P.M. at the Breaux Bridge City Hall, 101 Berard Street, Breaux Bridge, Louisiana.

Upon motion of Gary Champagne, duly seconded by Glenn Michael Angelle and unanimously carried the Board of Aldermen moved to go into executive session.

Upon motion of Gary Champagne, duly seconded by Ernest Ledet and unanimously carried the Board of Aldermen moved to come out of executive session.

Upon motion of Ernest Ledet, duly seconded by Howard Alexander and unanimously carried the Board of Aldermen moved to accept the Chief’s recommendation of Disciplinary Action according to his letter dated October 28, 2016 on police personnel.

Upon motion of Brenda Castille Hobbs, duly seconded by Howard Alexander and unanimously carried the meeting was adjourned.
