PROCEEDINGS OF THE MEETING OF THE MAYOR AND BOARD OF ALDERMEN OF THE CITY OF BREAUX BRIDGE HELD AT THE CITY HALL, 101 BERARD STREET, AT 6:00 P.M. ON TUESDAY, NOVEMBER 14, 2017.

 

Mayor Ricky Calais called the meeting to order, the Invocation and Pledge of Allegiance were recited.

 

Present:  Howard Alexander, Ernest Ledet, Glenn Michael Angelle and Gary Champagne.

 

Absent:  Brenda Castille Hobbs

 

Upon motion of Gary Champagne, duly seconded by Howard Alexander, and unanimously carried, the Board of Aldermen approved the following additions and deletions to the November Meeting Agenda.

 

Additions:

  1. To appoint Mellissa Narcisse to the Planning and Zoning Commission to replace Ashely Courville.
  2. (An ordinance to amend Chapter 23 of the Code of Ordinances by the repeal, amendment, revision, enactment, and/or re-enactment of Sections 23-3.1, 23-4.19, 23-4.20, 23-4.26, 23-5.7, 23-5.8, 23-5.9, 23-5.10, 23-10a, 23-5.16 through 23-5.16.8, 23-10.1, 23-10.3 and 23-11.1 regarding zoning regulations.)

 

Deletions:

  1. Consider the recommendation from Zoning Commission to rezone a 2.15 acre lot at the corner of South Poydras Street and Hollier Road from RESIDENTIAL 2, with the intent to subdivide the lot into 7 individual lots. – Amanda Leblanc, Planning and Zoning Director
  2. Consider adopting a resolution removing residency requirements for serving on the Civil Service Board – Chief Cantu

 

Upon motion of Ernest J. Ledet duly seconded by Glenn M. Angelle and unanimously carried, the minutes of the October 10, 2017 City Council meeting were approved.

 

Presentation of Audit report by Russell Champagne with Kolder, Champagne, Slaven & Company, LLC.

 

Presentation to Mr. Wilson Thibodeaux thanking him for his many years of service to the City of Breaux Bridge and the Breaux Bridge Community.

 

The Board of Aldermen granted a 90 day extension on Rule to Show Cause to Ms. Shelia Maiben to complete clean up and repairs on property located at 633 Anderson Street.

 

After learning of a designated representative appointed during filed succession, the Board of Aldermen approved to serve Rule to Show Cause to the appointed  Representative on property located at 602 Blanchard Street.

 

Upon motion of Howard Alexander, duly seconded by Glenn Michael Angelle, and unanimously carried, the Board of Aldermen approved to open a public hearing for Ordinance #2239 (An ordinance to amend Article II of Chapter 4 of the Code of Ordinances for the City of Breaux Bridge, Louisiana, by the repeal of Sections 4-16 through 4-18 and Sections 4-31 through 4-41, and by the enactment and/or re-enactment of Sections 4-16 through 4-29, relative to the regulation of Parades and Footraces.)

 

Upon motion of Howard Alexander, duly seconded by Glenn Michael Angelle, and unanimously carried, there being no public input the public hearing on Ordinance #2239 was closed.

 

The Board of Aldermen decided to postpone adoption of Ordinance #2239 until the next council meeting.

 

Upon motion of Glenn M. Angelle, duly seconded by Ernest J. Ledet and unanimously carried, the Board of Aldermen approved to open a public hearing for Ordinance #2240 (An ordinance to amend Chapter 15 of the Code of Ordinances by the repeal, amendment, revision, enactment, and/or re-enactment of Sections 15-1, 15-2, 15-4, 15-9, and 15-18 and 15-31 through 15-40 regarding the regulation of public parks and recreational facilities).

 

Mayor Calais explained the purpose of the ordinance would only govern the use of the parks which right now there is really nothing in place.

 

City Attorney Hebert explained that this ordinance would only amend the current ordinances (about 20 in place right now) and that this ordinance would make things a little more stringent with the application process for rental/reservation of a park which would help the Mayor and Administration regulate the policy and procedures in connection with the parks.  Everything would not have to go before the Board of aldermen except for Veterans Park, anything in Veterans Park for the exception of the American Legion/the Veterans must go before the Board of Aldermen.

 

Mr. George Blanchard addressed if there was a fee charged for the parks?

 

Mayor Calais stated that the only park being charged fees and required to have insurance is Parc Hardy if it was being used by an out of town person coming in to use it, and that local citizens fees for use of the park was waived.

 

Upon motion of Howard Alexander, duly seconded by Glenn M. Angelle and unanimously carried, there being no further input the hearing was closed.

 

The Board of Aldermen agreed to postpone adoption of ordinance #2240 until the next council meeting.

 

Upon motion of Glenn Michael Angelle, duly seconded by Howard Alexander, and unanimously carried, the Board of Aldermen Introduced Ordinance #2242 (An ordinance to amend Ordinance Number 2163, providing for the creation of “Sales Tax District No. 1 of the City of Breaux Bridge, State of Louisiana” relative to the extension of the boundaries of Sales Tax District No. 1 of the City of Breaux Bridge, State of Louisiana, and the use and expenditure of the proceeds generated by Sales Tax District No. 1 of the City of Breaux Bridge, State of Louisiana; and relative to the amendment of the Intergovernmental Agreement adopted under Ordinance Number 2163 to incorporate the extended boundaries of Sales Tax District No. 1 of the City of Breaux Bridge, State of Louisiana, and amendment of the use and expenditure of the proceeds generated by Sales Tax District No. 1 of the City of Breaux Bridge, State of Louisiana.

 

Upon motion of Howard Alexander duly seconded by Gary Champagne and unanimously carried the Board of Aldermen Introduced Ordinance #2241 (An ordinance to amend Chapter 23 of the Code of Ordinances by the repeal, amendment, revision, enactment, and/or re-enactment of Sections 23-5.18, 23-5.18.2, 23-5.18.3 and 23-5.18.5 regarding the regulation and restrictions concerning mobile homes, trailers, and related structures and residences.)

 

Upon motion of Gary Champagne duly seconded by Glenn Michael Angelle and unanimously carried the Board of Aldermen appointed Mr. Wes Dupuis to the Planning and Zoning Commission.

 

Upon motion of Howard Alexander duly seconded by Gary Champagne and unanimously carried the Board of Aldermen appointed Ms. Melissa Narcisse to the Planning and Zoning Commission.

 

Upon motion of Howard Alexander duly seconded by Glenn Michael Angelle and unanimously carried the Board of Aldermen authorized Mayor Calais to advertise to receive and award bids for Parc Hardy Pavilion’s and Tennis Courts according to the Master Plan.

 

Upon motion of Howard Alexander duly seconded by Gary Champagne and unanimously carried the following Resolution and Notice of Acceptance was approved for the Refinery Street sidewalks.

 

RESOLUTION OF ACCEPTANCE

A resolution authorizing and directing the Mayor to execute for and on behalf of the City of Breaux Bridge, Louisiana an Act of Acceptance from by Southern Constructors, LLC, of New Iberia, LA, Contractor, pertaining to the completion of the East Refinery Street Sidewalk Project for the City of Breaux Bridge, LA.

WHEREAS, Southern Constructors, LLC, as Contractor, has substantially completed the East Refinery Street Sidewalk Project for the City of Breaux Bridge, Louisiana, in accordance with the plans and specifications contained in the Contract Documents pertaining thereto; and

WHEREAS, the City of Breaux Bridge, Louisiana acting through its Mayor and Councilmen, desires to accept the completed work;

NOW, THEREFORE, IT BE RESOLVED by the Councilmen of the City of Breaux Bridge, Louisiana, acting as the governing authority for the said City of Breaux Bridge, that the Mayor, be and he is hereby empowered, authorized and directed to execute an Act of Acceptance for and on behalf of the City of Breaux Bridge, Louisiana, accepting the work as being complete, and that he be authorized and directed to have a copy of said Acceptance recorded in the Conveyance Records of the Parish of St. Martin, State of Louisiana.

The foregoing resolution was offered by Howard Alexander and

seconded by Gary Champagne.

This resolution having been submitted to a vote, the vote thereon was as follows:

NAYS: None

ABSENT: Brenda Castille Hobbs

AND the resolution was declared adopted on this the 14th day of November 2017.

NOTICE OF ACCEPTANCE

TO ALL WHOM IT MAY CONCERN, and especially to all subcontractors, workmen, laborers, mechanics, and furnishers of materials:

Public Notice is hereby given according to law that the undersigned Owner has accepted, as substantially complete, the work done on the East Refinery Street Sidewalk Project by Southern Constructors, LLC, Contractor, under his contract with the City of Breaux Bridge, Louisiana, dated September 15, 2017, and recorded under Inst. No. 512025 in the Records of the Clerk of Court, Parish of St. Martin, Louisiana;

All subcontractors, workmen, laborers, mechanics, and furnishers of materials must assert whatever claim they may have against the said Contractor, growing out of the execution of said Contract, according to law, within 45 days from registration hereof.

Upon motion of Howard Alexander, duly seconded by Glenn Michael Angelle and unanimously carried the following Resolution and Notice of Acceptance was approved for the Water Extension Project North of I-10.

 

Resolution of Acceptance

 

A resolution authorizing and directing the Mayor to execute for and on behalf of the City of Breaux Bridge, Louisiana an Act of Acceptance from C.G. Logan Construction, LLC of Evergreen, LA, Contractor, pertaining to the completion of the Part A – Water Extension,       I-10 Service Road Project for the City of Breaux Bridge, LA.

 

Whereas, C.G. Logan Construction, LLC, as Contractor, has substantially completed the Part A – Water Extension, I-10 Service Road Project for the City of Breaux Bridge, Louisiana, in accordance with the plans and specifications contained in the Contract Documents pertaining thereto; and

 

Whereas, the City of Breaux Bridge, Louisiana acting through its Mayor and Councilmen, desires to accept the completed work;

Logan Construction, LLC, Contractor, under his contract with the City of Breaux Bridge, Louisiana, dated July 12, 2017, and recorded under Inst. No. 510236 in the Records of the Clerk of Court, Parish of St. Martin, Louisiana;

 

All subcontractors, workmen, laborers, mechanics, and furnishers of materials must assert whatever claim they may have against the said Contractor, growing out of the execution of said Contract, according to law, within 45 days from registration hereof.

Upon motion of Glenn Michael Angelle and seconded by Howard Alexander and unanimously carried the Board of Aldermen authorized Mayor Calais to hire a contractor to have the fire hydrants tested.

 

Upon motion of Glenn M. Angelle duly seconded by Howard Alexander and unanimously carried the Board of Aldermen approved to open a public hearing on Ordinance # 2235 (An ordinance to amend Chapter 23 of the Code of Ordinances by the repeal, amendment, revision, enactment, and/or re-enactment of Sections 23-3.1, 23-4.19, 23-4.20, 23-4.26, 23-5.7, 23-5.8, 23-5.9, 23-5.10, 23-10a, 23-5.16 through 23-5.16.8, 23-10.1, 23-10.3 and 23-11.1 regarding zoning regulations.

 

Upon motion of Ernest Ledet duly seconded by Gary Champagne and unanimously carried the Board of Aldermen moved to close the public hearing on Ordinance #2235.

 

The Board of Aldermen decided to table Ordinance #2235 until a later meeting.

 

Upon motion of Gary Champagne, duly seconded by Glenn Michael Angelle and unanimously carried, the meeting was adjourned.
