October 2016- Special Meeting

PROCEEDINGS OF A SPECIAL MEETING OF THE MAYOR AND BOARD OF ALDERMEN OF THE CITY OF BREAUX BRIDGE HELD AT THEIR REGULAR MEETING PLACE, THE CITY HALL, 101 BERARD STREET, BREAUX BRIDGE, LOUISIANA AT 6:00 P.M. ON TUESDAY, OCTOBER 25, 2016.

 

Mayor Ricky Calais called the meeting to order, the Pledge of Allegiance and the Invocation were recited.

 

Present:  Brenda Castille Hobbs, Howard Alexander, Ernest “E.J.” Ledet, Glenn Michael Angelle and Gary Champagne

 

Absent:  None

 

Upon motion of Howard Alexander duly seconded by Ernest Ledet and carried the Board of Aldermen granted a variance regarding permit by Leona Williams for Trailer at 1810 Rees Street Lot #33: Future Variance agreed based on reasons below, and only upon satisfaction of below conditions:

 

  1. Applicant’s property is located in an R4 Zoning District which allows for trailers.
  2. Applicant has resided at this property for 17 years and was living at location in a mobile home that satisfies the requirements under the zoning ordinance, when mobile home was completely destroyed by accidental event/fire.
  3. Applicant moved a mobile home that was in a better condition that the previous mobile home onto the property after destruction of said mobile home, and has made improvements to said mobile home as requested by the City inspector.
  4. Applicant will be allowed until the Board of Aldermen meeting on December 13, 2016 to complete either of the following: (1) make all improvements/renovations to the mobile home so as to comply with all standards of the International Property Maintenance Code 2012 and the City’s building inspector, Mr. Richard must inspect the property, confirm that all said standards have been satisfied, and issue to the City a written report that evidences said inspection and opinion; or (2) remove the mobile home from the property.
  5. Applicant shall pay any and all permits or fees necessary for temporary utilities to the mobile home so that repairs can be made, and the City can confirm that all standards have been satisfactorily met, in compliance with requirements above.
  6. Upon payment of necessary fees and permits, the City will allow Applicant temporary access to electricity to the extent necessary to perform the required improvements or repairs on the mobile home and/or show that the mobile home satisfies all standards set forth above.
  7. Upon payment of necessary fees and permits, the City will allow Applicant temporary connection to water and sewer to the extent necessary to perform the required improvements or repairs on the mobile home and/or to show that all plumbing satisfies the standards set forth above.
  8. In light of the conditions set forth in paragraphs a, b and c above, and only upon the timely and satisfactory completion of the requirements set forth in paragraphs d, e, f and g above on or before 6:00 P.M. on December 13, 2016, the Board of Adjustments shall grant a variance to Applicant to allow the mobile home to remain situated on the property and permits be issued by the City in furtherance thereof. If all requirements are met and Mr. Richard has certified satisfaction requirements and has given his report in writing to the City confirming same prior to December 13, 2016, then upon receipt of satisfactory report by Mr. Richard, and confirmed by the Board of Adjustments, the variance shall be granted and the City may issue the appealed upon permit to Applicant.

 

Before the roll call vote Ms. Brenda Castille Hobbs requested City Attorney Bart Hebert to go thru the eight limited reasons to grant a variance to see if it applied in this case.   City Attorney Bart Hebert answered “No” to all eight of the limited reasons to grant a variance.

Due to 3 to 2 vote Appeal #1 was granted with the above conditions.

 

Upon motion of Howard Alexander duly seconded by Ernest Ledet, a request to approve a variance regarding permit by Donald Gene Lewis, Elaine Jean Lewis, et al for trailer at 611 Valsin Street failed for lack of votes.  Before roll call vote Ms. Brenda Castille Hobbs requested City Attorney Bart Hebert to go thru all eight of the limited reasons to grant a variance.   City Attorney Bart Hebert answered “No” to all eight of the limited reason to grant a variance.

                District B              Yes

                District C              Yes

                District D             No

                District E              No

               

For lack of votes the variance for appeal #2 was denied.

 

 

Upon motion of Howard Alexander duly seconded by Ernest Ledet, a request to approve a variance regarding permit by Alton Perry and Mary Pete for trailer at 450 Castille Street failed for lack of votes.  Before roll call vote Ms. Brenda Castille Hobbs requested City Attorney Bart Hebert to go thru the eight limited reasons to grant a variance to see if it applied in this case.   City Attorney Bart Hebert answered “No” to all eight of the limited reasons to grant a variance.

For lack of votes the variance for Appeal #3 was denied.

 

Upon motion of Gary Champagne duly seconded and unanimously carried the meeting was adjourned.
