PROCEEDINGS OF THE MEETING OF THE MAYOR AND BOARD OF ALDERMEN OF THE CITY OF BREAUX BRIDGE HELD AT CITY HALL, 101 BERARD STREET, AT 6:00 P.M. ON TUESDAY, JULY 9, 2024. Mayor Ricky Calais called the meeting to order, the invocation and the Pledge of Allegiance were recited. Monthly budget-to-actual comparisons on the General Funds, Sales Tax Funds, Park and Recreation Fund and Utility Funds were distributed to the councilmen and Mayor. Present: Albert Menard, Neil Melancon and Eddy LeBlanc. Absent: Scotty Borel and Ryan Breaux Upon motion of Albert Menard, duly seconded by Eddy LeBlanc, and unanimously carried the minutes of the June 11, 2024 meeting of the Mayor and Board of Aldermen were approved. Upon motion of Albert Menard, duly seconded by Neil Melancon, and unanimously carried, the Board of Aldermen opened a public hearing for Ordinance #2304 (An ordinance to amend Chapter 23 of the Code of Ordinances, the Zoning Ordinance, by the repeal, amendment, revision, enactment, and/or re-enactment Sections 23-5.10, and 23-5.10.a, regarding zoning regulations applicable to C-1, concerning neighborhood mixed districts, and matters related thereto.) Planning and Zoning Director, Jeremy Broussard that this Ordinance had been previously introduced and that the Planning and Zoning Board recommended it for approval by the Board of Aldermen. Upon motion of Albert Menard duly seconded by Neil Melancon and unanimously carried, and having no further input from the council or public, the Board of Aldermen closed the Public Hearing on Ordinance #2304. Upon motion of Albert Menard, duly seconded by Neil Melancon and unanimously carried, the Board of Aldermen adopted Ordinance #23042304 (An ordinance to amend Chapter 23 of the Code of Ordinances, the Zoning Ordinance, by the repeal, amendment, revision, enactment, and/or re-enactment Sections 23-5.10, and 23-5.10.a, regarding zoning regulations applicable to C-1, concerning neighborhood mixed districts, and matters related thereto.) ORDINANCE NUMBER 2304 An ordinance to amend Chapter 23 of the Code of Ordinances, the Zoning Ordinance, by the repeal, amendment, revision, enactment, and/or re-enactment Sections 23-5.10, and 23-5.10.a regarding zoning regulations applicable to C-1, concerning neighborhood mixed districts, and matters related thereto. BE IT ORDAINED by the Mayor and Board of Alderman for the City of Breaux Bridge, Louisiana duly convened in regular session on the 9th day of July, 2024, that: The Code of Ordinances for the City of Breaux Bridge, Louisiana be amended by the repeal, amendment, revision, enactment, and/or re-enactment of Chapter 23 of the Code of Ordinances, the Zoning Ordinance, at Sections 23-5.10, and 23-5.10.a as follows: Sec. 23-5.10 – C-1, Neighborhood Mixed District. Permitted uses: Single family dwellings, churches and temples, public and private schools (this includes public and private nursery schools and kindergartens but does not include trade and business schools), parks and playgrounds, private recreational uses, libraries and museums, private gardens, plant nurseries, home occupation and accessory uses, fresh produce farmers market, coffee shop, gas station, business or professional offices, bicycle shop, health food shop, hobby shop, bakery, small neighborhood grocery, pharmacy, credit union office, hospice office, laundromat, mail outlet, bookstore, gift shop, flower shop, and small deli, barber shop, beauty parlor and antique shop. Minimum lot area: Five thousand square feet Minimum yards: Front depth 15 feet. Front width, fifty feet. Side five (5) feet provided the buildings are of fireproof construction; otherwise a ten (10) foot minimum side yard is required. Rear yard must equal twenty (20%) of lot depth but is not required to exceed twenty-five (25) feet. No permitted commercial use shall be allowed unless it satisfies the following requirements: 2. Lot is not utilized for residential purposes, 3. Business is only allowed to operate between 5:00 a.m. and 9:00p.m. 4. Signs can only be illuminated during hours of operation. Sec. 23-5.10.a. – C-1, Neighborhood Business District. Reserved. BE IT FURTHER ORDAINED by the Board of Aldermen for the City of Breaux Bridge, Louisiana, that all other ordinances and provisions of the Code of Ordinances for the City of Breaux Bridge, Louisiana, that are in conflict with the provisions hereof are hereby declared to be repealed to the extent any such conflict exists. BE IT FURTHER ORDAINED by the Board of Aldermen for the City of Breaux Bridge, Louisiana, that the provisions of this ordinance are hereby declared to be severable, and if any provision, word, phrase, or clause of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect the validity of the remaining portions thereof. BE IT FURTHER ORDAINED by the Board of Alderman for the City of Breaux Bridge, Louisiana, duly convened in regular session on the 9th day of July, 2024, that this ordinance shall become effective upon signature of the Mayor of the City of Breaux Bridge, Louisiana, the lapse of ten (10) days after receipt of the Mayor of the City of Breaux Bridge, Louisiana without signature or veto, or upon an override of a veto, whichever occurs first.
