PROCEEDINGS OF THE MEETING OF THE MAYOR AND BOARD OF ALDERMEN OF THE CITY OF BREAUX BRIDGE HELD AT THE CITY HALL, 101 BERARD STREET, AT 6:00 P.M. ON TUESDAY, MAY 12,2026 Mayor Ricky Calais called the meeting to order; the Invocation and the Pledge of Allegiance were recited. Monthly budget-to-actual comparisons on the General Funds, Sales Tax Funds, Park and Recreation Funds, and Utility Funds were distributed to the councilmen and Mayor. Present: Ryan Breaux, Scotty Borel, Neil Melancon, Albert Menard, and Eddy Leblanc Upon motion of Albert Menard, duly seconded by Scotty Borel and unanimously carried, a resolution supporting application to AMPO for Poydras Street sidewalks was added as Item #15 to the agenda. Upon motion of Albert Menard, duly seconded by Ryan Breaux and unanimously carried, open bids for surplus equipment advertised April 22, 2026 was added as Item #16 to the agenda. Upon motion of Albert Menard, duly seconded by Neil Melancon and unanimously carried, the minutes of the April 14, 2026 council meeting were approved. Upon motion of Albert Menard, duly seconded by Neil Melancon and unanimously carried the council moved to go into executive session. Upon motion of Albert Menard, duly seconded by Neil Melancon and unanimously carried, the council moved to come out of executive session. Chester Cedars gave an update on the litigation with RaceTrac appeal lodged by the owners and informed that the city had prevailed on every previous matter and advised the matter would be argued before the 3rd Circuit Court of Appeals, and that he felt the city has strong legal standing. Upon motion of Albert Menard, duly seconded by Ryan Breaux and unanimously carried, the following resolution was adopted: Resolution of Acceptance A RESOLUTION AUTHORIZING AND DIRECTING THE MAYOR TO EXECUTE FOR AND ON BEHALF OF THE CITY OF BREAUX BRIDGE OF THE PARISH OF ST. MARTIN, LOUISIANA, AN ACT OF ACCEPTANCE FROM NCMC, LLC CONTRACTOR, PERTAINING TO THE COMPLETION OF A CONTRACT FOR THE FILTER REHABILITATION AT THE BREAUX BRIDGE WATER TREATMENT PLANT Whereas, NCMC, L.L.C., as Contractor, has substantially completed the Filter Rehabilitation Project, for the City of Breaux Bridge, Louisiana, as of May 5, 2026, in accordance with the plans and specifications contained in the Contract Documents pertaining thereto, with the exceptions noted on the list of deficiencies attached hereto; and Whereas, the City of Breaux Bridge, Louisiana desired to accept the work as being substantially complete, subject to the correction within the lien period of the listed deficiencies; Now, therefore, it be resolved by the City of Breaux Bridge, of the Parish of St. Martin, Louisiana, that the Mayor of the said City of Breaux Bridge be and is hereby empowered, authorized and directed to execute an Act of Substantial Completion, accepting the work as being substantially complete and that the Mayor be authorized and directed to have a copy of said Notice of Substantial Completion recorded in the Conveyance Records of the Parish of St. Martin, State of Louisiana. The foregoing resolution was offered by Albert Menard and seconded by Ryan Breaux. This resolution having been submitted to a vote, the vote thereon was as follows: YEAS: Ryan Breaux, Scotty Borel, Albert Menard, Neil Melancon, Eddy LeBlanc NAYS: None ABSTAIN: None ABSENT: None And the resolution was declared adopted on this the 12th day of May 2026. /s/ Ricky Calais Ricky Calais, Mayor /s/ Kristi LeBlanc Kristi LeBlanc, City Clerk Upon motion of Albert Menard, duly seconded by Ryan Breaux and unanimously carried the public hearing on Ordinance # 2323(An Ordinance to declare vacant lot located at 329 Berard Street, Breaux Bridge, Louisiana 70517 not needed for any public purpose and to dispose of such property by private sale to Jerry Hale for $2000.00 (appraised price), and matters related thereto) was opened. Mayor Calais explained the small section of the property located at the corner of Dorset and Berard Street purchased by the city to widen the road and property owner Jerry Hale was the adjacent property owner to the property purchased and advised the council the city had no use for the property. Upon motion of Albert Menard, duly seconded by Eddy LeBlanc and unanimously carried there being no public input, the hearing was closed. Upon motion of Albert Menard, duly seconded by Scotty Borel and unanimously carried Ordinance #2323 was adopted. ORDINANCE NO. 2323 Ordinance to declare vacant lot located at 329 Berard Street, Breaux Bridge, Louisiana 70517 not needed for any public purpose and to dispose of such property by private sale to Jerry Hale for the sum of $2,000.00, the appraised fair market value of such property, and matters related thereto. WHEREAS, the City of Breaux Bridge (the “City”) purchased the property located at 329 Berard Street, Breaux Bridge, Louisiana 70517 (the “Property”) for the purpose widening of Dorset Street (the “Project”); WHEREAS, the Project did not require use of the entirety of the Property, and the unused portion of the Property remainingafter the Project (the “Lot”) is not needed for any public purpose by the City; WHEREAS, the City obtained an appraisal of the Lot by Ransel Real Estate Appraisals dated September 17, 2025 whereby the fair market value of the Lot was determined to be the sum of Two Thousand and No/100 ($2,000.00) Dollars (the “Appraised Value”); WHEREAS, Jerry Hale owns land adjacent to the Lot and has agreed to purchase the Lot from the City for the Appraised Value; WHEREAS, Louisiana R.S. 33:4712 authorizes a municipality to dispose of any property not needed for a public purpose; and the Mayor and the Board of Aldermen have determined that the Lot is no longer serves any public purpose; WHEREAS, pursuant to La. R.S. 33:4712 B, before the City may sell public property to private persons, it must declare that the property is no longer needed for a public purpose, and an ordinance must be introduced, giving the reasons for the action on the part of the…
