PROCEEDINGS OF THE MEETING OF THE MAYOR AND BOARD OF ALDERMEN OF THE CITY OF BREAUX BRIDGE HELD AT CITY HALL, 101 BERARD STREET, AT 6:00 P.M. ON TUESDAY, SEPTEMBER 10, 2024. Upon motion of Ryan Breaux, duly seconded by Albert Menard and unanimously carried, the Board of Aldermen approved the following addition to the agenda:  Item #13:  Consider approving the updated Parc Ridge Phase 1 plat        dated August 28, 2024 Upon motion of Albert Menard, duly seconded by Neil Melancon and unanimously carried, the Board of Aldermen approved the following addition to the agenda: Item #14:  Introduction of Ordinance #2306 (An Ordinance to amend Chapter 20 of the Code of Ordinances, by the repeal, amendment, revision, enactment, and/or re-enactment Section 20-81.6 regarding the regulation of mobile food vehicle peddlers, and matters related thereto.) Upon motion of Ryan Breaux, duly seconded by Neil Melancon and unanimously carried, the Board of Aldermen approved to delete the following item on the agenda: Item #8 Authorize the hiring of one patrol officer-Chief LeBlanc. Upon motion of Scotty Borel, duly seconded by Eddy LeBlanc and unanimously carried, the Board of Aldermen approved the minutes for the Regular Meeting of August 13, 2024. Upon motion of Albert Menard, duly seconded by Ryan Breaux and unanimously carried, the Board of Aldermen approved the purchase of two new patrol vehicles for the police department. Upon motion of Eddy LeBlanc, duly seconded by Albert Menard and unanimously carried, the Board of Aldermen approved the bid for the Gary Drive/Dell Drive Road project to be awarded to Elliott Construction, LLC in the amount of $626,680.00. Upon motion of Ryan Breaux, duly seconded by Albert Menard and unanimously carried, the Board of Aldermen approved to update the Parc Ridge Phase 1 plat dated August 28, 2024. Upon motion of Ryan Breaux, duly seconded by Albert Menard and unanimously carried, the Board of Aldermen approved to consider the following with respect to Phase 1 of Parc Ridge Subdivision:  approval of Parc Ridge Development, LLC’s submission of proposal for Act of Dedication to the City, approval of Acknowledgement and Acceptance of Parc Ridge Development, LLC’s Dedication by the City and grant of authority for Mayor to execute same on behalf of the City ; approval and acceptance of Parc Ridge Development, LLC and J. Breaux Enterprises, LLC’s request to the City to accept the Phase 1 subdivision improvements as completed; approval of City Engineer’s determination of amount for the construction costs of the Phase 1 subdivision improvements for purposes of warranty and maintenance agreements and maintenance bonds; approval Initial Two Year Warranty and Maintenance Agreement between City and   Parc Ridge Development, LLC and J. Breaux Enterprises, LLC and grant of authority for Mayor to execute same on behalf of the City, approval and acceptance of maintenance bonds for first year and second year of  Initial Two Year Warranty and Maintenance Agreement between City and Parc Ridge Development, LLC and J. Breaux Enterprises.  Upon motion of Albert Menard, duly seconded by Eddy LeBlanc and unanimously carried, the Board of Aldermen approved to adopt Ordinance #2305 (An ordinance to create Chapter 24-Mobile Home, Mobile Home Parks, Recreational Vehicle Parks, Mobile Food Vehicle, and Mobile Food Vehicle Parks). ORDINANCE NUMBER 2305 An ordinance to enact and adopt Chapter 24 of the Code of Ordinances, Section Numbers 24-1 through 24-230 regarding the regulation of mobile homes, manufactured homes, mobile home parks, recreational vehicle parks, mobile food vehicles and mobile food vehicle parks. BE IT ORDAINED by the Mayor and Board of Alderman for the City of Breaux Bridge, Louisiana duly convened in regular session on the 10th day of September 2024, that: The Code of Ordinances for the City of Breaux Bridge, Louisiana be amended by the enactment and adoption of Chapter 24 of the Code of Ordinances, Section Numbers 24-1 through 24-230 regarding the regulation of mobile homes, manufactured homes, mobile home parks, recreational vehicle parks, mobile food vehicles and mobile food vehicle parks, as follows: ARTICLE I.  IN GENERAL Sec. 24-1. – Definitions. The following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning: Accessory building means a subordinate building on a lot, the use of which is customarily incidental, secondary, or minor to that of the main building or principle building.  Accessory structure means any structural additions to the mobile home or manufactured home, which includes awnings, cabanas, carports, Florida rooms, porches, ramadas, storage cabinets and similar appurtenant structures. Agent means any person authorized by the licensee of a mobile home or manufactured home park and/or subdivision to operate, develop and/or maintain such park and/or subdivision under the provisions of this chapter. Building means a roofed structure created for permanent use. Building official means the officer or other person charged with the administration and enforcement of the building code ordinances, or his duly authorized representative. Commercial use means use for business or other governmental entity purposes, such as, without limitation, first responders, or for uses other than permanent or temporary residential purposes. Common area means any area or space designed for joint use of occupants of parks and/or subdivisions. Density means the number of mobile home or manufactured home stands per gross acre. Doublewide mobile home means a mobile home with two or more units separately towable but designed to be joined onto an integral unit at the site. Driveway means a minor private path used by vehicles and pedestrians on a space or for common access to a small group of spaces or common facilities. Upon motion of Albert Menard, duly seconded by Scotty Borel, and unanimously carried, the Board of Aldermen opened a public hearing for Ordinance 2296 (An ordinance to amend Chapter 23 of the Code of Ordinances, the Zoning Ordinance, by the repeal, amendment, revision, enactment, and/or re-enactment of Section 23-5.5 and 23-5.18.3 regarding zoning regulations applicable to R-4 concerning mobile homes, installation standards for mobile homes and matters related thereto.) Planning and zoning director, Jeremy Broussard explained the changes that were being made to this ordinance.  One of the changes is to include the words “mobile home,” which was left out of the ordinance due to an oversight. The second change was making the maximum age of allowed mobile homes to be 10 years. Upon motion of Eddy LeBlanc, duly seconded by Albert Menard, and unanimously carried, there being no public input the public hearing on Ordinance #2296 was closed. Upon motion of Albert Menard, duly seconded by Neil Melancon, and unanimously carried, the Board of Aldermen approved the minutes of the March 12, 2024, City Council Meeting. Upon motion of Albert Menard, duly seconded by Scotty Borel, and unanimously carried, the Board of Aldermen adopted a resolution proclaiming April to be “Fair Housing Month”. STATE OF LOUISIANA City of Breaux Bridge PROCLAMATION WHEREAS, Title VIII of the Civil Rights Act of 1968, during the month of April, is an occasion for all Americans – individually and collectively – to rededicate themselves to the principle of freedom from housing discrimination wherever it exists; and WHEREAS, this law guarantees for each citizen that critical, personal element of freedom of choice – selection of the home, and WHEREAS, a fair housing law has been passed by the State of Louisiana, and implementation of the law requires the positive commitment, involvement and support of each of our citizens, and WHEREAS, the department and agencies of the State of Louisiana are to provide leadership in the effort to make fair housing not just an idea, but an ideal for all our citizens, and WHEREAS, barriers that dimmish the rights and limit the options of any citizen to freely choose a home will ultimately diminish the rights and limit the options of all; NOW, THEREFORE BE IT RESOLVED; the City of Breaux Bridge does hereby proclaim the month of April 2024 as FAIR HOUSING MONTH In the City of Breaux Bridge  ______________________ Ricky J. Upon motion of Albert Menard, duly seconded by Ryan Breaux and unanimously carried the public hearing on Ordinance #2292(An ordinance to amend Chapter 23 of the Code of Ordinances, the Zoning Ordinance, by the repeal, amendment, revision, enactment, and/or re-enactment of Sections 23-5.11 and 23-5.19.3 regarding zoning regulations applicable to all C-2 and C-6 zoning districts, concerning regulation of overnight camping and/or recreational vehicle parks, and matters related thereto) was opened. Planning and zoning director, Jeremy Broussard explained the Ordinance was removing camp grounds and over night camping out of commercial districts C2 and C6 that have no regulations for it.  It is to remove them and come up with regulations to define and place what and where they want RV Park to be allowed. Mayor Calais explained he and Jeremy spoke and that Jeremy knows the neighboring cities that do not have specific sections or zones in their communities for campgrounds.  They basically adopt minimum design that if you want to come to their community this is the design you have to meet, very strict standards you have to build it, examples are paved roads and paved pads for the campers.  Mayor Calais stated there is no specific area in town you can put it.  They can come in front of the Planning and Zoning and council to state where they want to put it, they pick an area and come to get permission to put it there, that way it can be better regulated. Jeremy voiced it would make it more convenient to where the city would guide and place certain uses, that way they are not rezoning property and that way they don’t rezone property for campground and if they decide not to do the campground they don’t do some other use due to the rezoning of the property. ABSENT:  Neil Melancon Upon motion of Ryan Breaux, duly seconded by Albert Menard and unanimously carried, the Board of Aldermen approved the addition of one item to the agenda:             Item #14:    A Resolution authorizing an agreement with the state of Louisiana regarding the Grand Point sidewalk project. Upon motion of Albert Menard, duly seconded by Eddy Leblanc, and unanimously carried the minutes of the November 14, 2023 Mayor and Board of Aldermen meeting was approved. Upon motion of Albert Menard, duly seconded  by Ryan Breaux and unanimously carried, the Board of Aldermen authorized Chief of Police Albert Leblanc to hire 3 New Patrol Officers as listed below:             Keilan Boyd             Traven Leblanc             Ryan Savoie Upon motion of Albert Menard, duly seconded by Eddy LeBlanc and unanimously carried the Board of Aldermen authorized Chief of Police Albert Leblanc to purchase 1 license plate reader system for 1 patrol car. Upon motion of Ryan Breaux, duly seconded by Eddy Leblanc, and unanimously carried, the Board of Aldermen introduced Ordinance #2292 (An ordinance to amend Chapter 23 of the Code of Ordinances, the Zoning Ordinance, by the repeal, amendment, revision, enactment, and /or re-enactment of Sections 23-5.11 and 23-5.19.3 regarding zoning regulations applicable to all C-2 and C-6 zoning districts, concerning regulation of overnight camping and/or recreational vehicle parks, and matters related thereto.) Upon motion of Eddy Leblanc, duly seconded by Albert Menard, and unanimously carried, the Board of Aldermen authorizing the Mayor to sign the documented regarding Grand Point sidewalk project. CITY OF BREAUX BRIDGE RESOLUTION A RESOLUTION AUTHORIZING AN AGREEMENT WITH THE STATE OF LOUISIANA REGARDING THE GRAND POINT SIDEWALK PROJECT WHEREAS,   the City of Breaux Bridge has been approved by the Acadiana Metropolitan Planning Organization for funding for State Project No. H.015354, the Grand Point Sidewalk project; and WHEREAS,   an agreement between Louisiana DOTD and the City of Breaux Bridge must be executed; and WHEREAS,   Mayor Ricky Calais is the Chief Executive of the City of Breaux Bridge; and WHEREAS,  on this 12th day of  December, 2023, the Board of Aldermen of the City of Breaux Bridge, Louisiana, did meet in open and regular session in order to consider this Resolution; and NOW THEREFORE BE IT RESOLVED that the Board of Aldermen of the City of Breaux Bridge authorizes and directs Mayor Ricky J. Calais to execute said agreement by way of his signature in support of the Grand Point Sidewalk project. This Resolution shall become effective immediately upon its adoption. By motion of Aldermen Eddy LeBlanc, duly seconded by Aldermen Albert Menard, the above Resolution was adopted by the following vote on this 12th day of December, 2023: YEAS: Ryan Breaux, Scotty Borel, Albert Menard, Eddy LeBlanc              NAYS: None ABSENT: Neil Melancon       ABSTAIN: None                                                                    AND THIS RESOLUTION was declared adopted as of the 12th day of December, 2023.
