PROCEEDINGS OF THE MEETING OF THE MAYOR AND BOARD OF ALDERMEN OF THE CITY OF BREAUX BRIDGE HELD AT THE CITY HALL, 101 BERARD STREET, AT 6:00 P.M. ON TUESDAY, JANUARY 9, 2024. Mayor Ricky Calais called the meeting to order, the invocation and the Pledge of Allegiance were recited. Monthly budget-to-actual comparisons on the General Funds, Sales Tax Funds, Park and Recreation Fund, and Utility Funds were distributed to the councilmen and Mayor. PRESENT:    Ryan Breaux, Scotty Borel, Albert Menard, Neil Melancon and Eddy Leblanc. ABSENT:  None Upon motion of Albert Menard, duly seconded by Ryan Breaux, and unanimously carried the minutes of the December 12, 2023 Mayor and Board of Aldermen meeting was approved. Upon motion of Ryan Breaux, duly seconded by Eddy LeBlanc and carried, with a recusal by Alderman Menard, the Board of Aldermen awarded the bids of surplus vehicles and equipment. Upon motion of Scotty Borel, duly seconded by Albert Menard and unanimously carried, the Board of Aldermen approved an additional amount of approximately $33,000 to complete the improvement projects in Carl Williams Park. Upon motion of Scotty Borel, duly seconded by Neil Melancon and unanimously carried, the Board of Aldermen elected Alderman Albert Menard to the position of Mayor Pro Tempore for the year of 2024. Upon motion of Albert Menard, duly seconded by Scotty Borel and unanimously carried, the Board of Aldermen introduced Ordinance #2293 (An ordinance to amend Chapter 23 of the Code of Ordinances, the Zoning Ordinance, by the repeal of Sections 23-4.28 through 23-4.28.5, and by the repeal, amendment, revision, enactment, and/or re-enactment of Sections 23-9 through 23-9.4 regarding zoning regulations and home occupation and matters related thereto.). Upon motion of Albert Menard, duly seconded by Ryan Breaux and unanimously carried, the Board of Aldermen introduced Ordinance #2294 (An ordinance to amend Chapter 23 of the Code of Ordinances, by the repeal, amendment, revision, enactment, and/or re-enactment of Sections 23-11.2 and 23-13.2(3) regarding zoning regulations and fees for appeals to the board of adjustment and petitions for amendment of a zoning ordinance and matters related thereto.). Upon motion of Albert Menard, duly seconded by Ryan Breaux and unanimously carried, the Board of Aldermen introduced Ordinance #2295 (An ordinance to amend Chapter 19 of the Code of Ordinances, by the repeal, amendment, revision, enactment, and/or re-enactment of Sections 19-13, 19-46 and 19-48 regarding subdivision regulation and fees for plan review and matters related thereto.). Upon motion of Ryan Breaux, duly seconded by Albert Menard and unanimously carried, the Board of Aldermen approved funding for baseball/softball facility dugout expansion and dugout benches in Parc Hardy for the approximate amount of $70,000. Upon motion of Ryan Breaux, duly seconded by Eddy Leblanc, and unanimously carried, the Board of Aldermen introduced Ordinance #2292 (An ordinance to amend Chapter 23 of the Code of Ordinances, the Zoning Ordinance, by the repeal, amendment, revision, enactment, and /or re-enactment of Sections 23-5.11 and 23-5.19.3 regarding zoning regulations applicable to all C-2 and C-6 zoning districts, concerning regulation of overnight camping and/or recreational vehicle parks, and matters related thereto.) Upon motion of Eddy Leblanc, duly seconded by Albert Menard, and unanimously carried, the Board of Aldermen authorizing the Mayor to sign the documented regarding Grand Point sidewalk project. CITY OF BREAUX BRIDGE RESOLUTION A RESOLUTION AUTHORIZING AN AGREEMENT WITH THE STATE OF LOUISIANA REGARDING THE GRAND POINT SIDEWALK PROJECT WHEREAS,   the City of Breaux Bridge has been approved by the Acadiana Metropolitan Planning Organization for funding for State Project No. H.015354, the Grand Point Sidewalk project; and WHEREAS,   an agreement between Louisiana DOTD and the City of Breaux Bridge must be executed; and WHEREAS,   Mayor Ricky Calais is the Chief Executive of the City of Breaux Bridge; and WHEREAS,  on this 12th day of  December, 2023, the Board of Aldermen of the City of Breaux Bridge, Louisiana, did meet in open and regular session in order to consider this Resolution; and NOW THEREFORE BE IT RESOLVED that the Board of Aldermen of the City of Breaux Bridge authorizes and directs Mayor Ricky J. Calais to execute said agreement by way of his signature in support of the Grand Point Sidewalk project. This Resolution shall become effective immediately upon its adoption. The is committed through adoption of this plan to full and total involvement of all residents of the community in the composition, implementation and assessment of its Louisiana Community Development Block Grant (LCDBG) Program. Attempts will be made to reach all citizens, with particular emphasis on participation by persons of low and moderate income, residents of slum and blighted areas and of areas in which funds are proposed to be used. A copy of this plan will be made available to the public upon request. ABSENT:  None Upon motion of Neil Melancon, duly seconded by Ryan Breaux and unanimously carried, the Board of Aldermen approved the addition of the following item to the agenda:            Item #13: Approve recommendation to award the low bidder on sewer pond rehab project to NCMC contingent upon final approval of the funding agency. Upon motion Albert Menard, duly seconded by Eddy LeBlanc, and unanimously carried, the Board of Aldermen approved the minutes of the August 8, 2023 City Council meeting. Upon motion of Ryan Breaux, duly seconded by Albert Menard and unanimously carried, the Board of Aldermen opened a public hearing for Ordinance #2291 (Be it ordained by the Board of Aldermen of the City of Breaux Bridge, Louisiana, that the municipal budget for fiscal year ending June 30, 2024 be amended according to the terms and figures contained in the attached exhibit identified as “Exhibit A”.). Mayor Calais explained the changes that were made either by him or at the request or suggestion of the council and referred to the handout that the Aldermen had received. The changes included increases in the salaries of the Aldermen and City Prosecutor, Marshal’s and Police department budgets to purchase defibrillators, Christmas light budget to replace old and broken decorations. The changes also included increases to various projects including the following: Tennis Courts at Parc Hardy, fencing and backstops for Parc Hardy, and increase in repairs and maintenance for the Bridge Street sewer project. Councilman Melancon requested the following to be added to the budget:A line item for District D Drainage and Infrastructure for $100,000 and District D Signage and Infrastructure for $100,000.  Councilman Melancon explained that he pursued state funding for projects for his district and therefore wanted those projects to be reflected in the budget. Council Borel requested that $10,000 be added to the line item for the Summer Recreation Program. Council LeBlanc requested that the Mayor’s salary be increased by 7%. Parks and Recreation Director Randy Cormier pointed out that the increase for Parc Hardy fencing that was explained earlier did not include upgrading the backstops.  He gave a quote for the entire project and asked that it also be included. Councilmen Melancon and Breaux spoke in favor of these upgrades. Councilman Breaux suggested an increase in the Chief’s salary of 3%. Upon motion of Ryan Breaux, duly seconded by Eddy LeBlanc and unanimously carried, the Board of Aldermen closed the public hearing for Ordinance #2291. Councilman Albert Menard motioned that all changes be approved and that the aldermen’s salary be increased and that the City Clerk’s salary be increased.  This motioned was seconded by Eddy LeBlanc and unanimously carried, the Board of Aldermen adopted Ordinance #2291 (Be it ordained by the Board of Aldermen of the City of Breaux Bridge, Louisiana, that the municipal budget for fiscal year ending June 30, 2024 be amended according to the terms and figures contained in the attached exhibit identified as “Exhibit A”.). Mayor Ricky Calais called the meeting to order, the invocation and the Pledge of Allegiance were recited. Monthly budget-to-actual comparisons on the General Funds, Sales Tax Funds, Park and Recreation Fund, and Utility Funds were distributed to the councilmen and Mayor. Upon motion of Ryan Breaux, duly seconded by Albert Menard and unanimously carried, the Board of Aldermen opened a public hearing for Ordinance #2288 (An ordinance to amend Chapter 3 of the Code of Ordinances, by the repeal, amendment, revision, enactment, and/or re-enactment of Sections 3-1, 3-27 and 3-40, applicable to alcoholic beverages, permits for the sale thereof, the location and operation of alcoholic beverage outlets and matters related thereto.). Planning and Zoning Director, Jeremy Broussard explained that the current ordinance prohibits some types of restaurants that include a bar feature to be opened within 300 feet of schools, nurseries, playgrounds, etc. The wording of the current ordinance would prohibit restaurants that are primarily restaurants, but include a bar area in them. He explained that this amended ordinance would alleviate the strictness of the original ordinance so as to allow these businesses to operate within this zone. Bart Hebert, the City Attorney, explained that this ordinance would be mimicking the state law on this matter and the City would no longer be more restrictive than state law. He also stated that the language of the ordinance needed to be clearer and that this amendment would clarify any confusion of the original about how to measure the distance from the business to daycares, schools, etc. Alderman Melancon pointed out that in this version of the ordinance, the City would only allow the restaurants to serve alcohol until 11:00 p.m. He requested that be changed to 12:00 p.m. midnight. Parish President, Chester Cedars discussed the current plans for St. Martin Parish Government for a road project that is originally budgeted for this year.  Doyle Melancon extension is one of the roads that is selected for reconstruction.  Mr. Cedars also mentioned that the city and parish are jointly responsible for the maintenance of that road.  St. Martin Parish Government is requesting that the city participate in the reconstruction of that road as part of the parish project.  The total estimated cost of the reconstruction is $930,000.00 that contains a 10% contingency at the estimated cost as of May 4, 2023.  Reconstruction of the Doyle Melancon project will be bid in September.  Upon motion of Eddy Leblanc, duly seconded by Neil Melancon, and unanimously carried, the Board of Alderman agreed to pursue a partnership with the parish to participate to the extent of 50% of the cost of the reconstruction of Doyle Melancon Extension. The following ordinance having been introduced at a special meeting on May 15, 2023, and notice of its introduction having been published in the official journal and a public hearing having been held in connection therewith on this date, was offered for final adoption by Albert Menard and seconded by Neil Melancon: ORDINANCE NO. 2287 An ordinance providing for the incurring of debt and issuance of Ten Million Dollars ($10,000,000) of Sales Tax Bonds, Series 2023 of the City of Breaux Bridge, State of Louisiana, and providing for other matters in connection therewith.             WHEREAS, the City of Breaux Bridge, State of Louisiana (the “Issuer”) is now receiving revenues derived from the levy and collection of a special one percent (1%) sales and use tax (the “Tax”) being levied and collected by the Issuer, pursuant to an election held in the Issuer on November 16, 2019, at which election the following proposition was approved by a majority of the qualified electors voting in such election, viz: PROPOSITION (SALES TAX) Shall the City of Breaux Bridge, State of Louisiana (the “City”), be authorized to levy and collect a tax of one percent (1%) (the “Tax”) upon the sale at retail, the use, the lease or rental, the consumption, and the storage for use or consumption, of tangible personal property and on sales of services in the City, all as defined by law, in perpetuity, beginning January 1, 2020 (an estimated $2,700,000 reasonably expected at this time to be collected from the levy of the Tax for an entire year), with the proceeds of the Tax (after paying the reasonable and necessary costs and expenses of collecting and administering the Tax) to be dedicated and used solely for the purposes of (i) acquiring, constructing, improving, maintaining and/or operating infrastructure, including public streets, sidewalks and rights-of-way, drainage, water works, parks and recreation facilities, and the purchasing and acquiring of necessary equipment, land and rights-of-way for any of the aforesaid public works, improvements and facilities, (ii) public safety, including police and fire operations, facilities and equipment and (iii) cultural and economic development?                   WHEREAS, pursuant to the authority of the aforesaid election, the Issuer adopted an ordinance providing for the levy and collection of the Tax beginning January 1, 2020 (the “Tax Ordinance”); and              WHEREAS, the Issuer now desires to incur debt and issue its Sales Tax Bonds, Series 2023, in the principal amount of Ten Million Dollars ($10,000,000) (the “Bonds”), pursuant to Part II of Chapter 4 of Subtitle II of Title 39 of the Louisi­ana Revised Statutes of 1950, as amended (the “Act”), for the purpose of (i) acquiring, constructing and/or improving infrastructure, including public streets, sidewalks and rights-of-way, drainage, water works, parks and recreation facilities, and the purchasing and acquiring of necessary equipment, land and rights-of-way for any of the aforesaid public works, improvements and facilities; (ii) paying the costs of issuance of the Bonds; and             WHEREAS, the Bonds shall be secured by and payable out of the proceeds of the Tax after the payment by the Issuer of the reasonable and necessary costs and expenses of collecting and administering the Tax (the “Net Revenues of the Tax”); and             WHEREAS, the Louisiana State Bond Commission approved the levy of the Tax at its meeting on September 19, 2019; and             WHEREAS, the maturities of the hereinafter described Bonds will be arranged so that the total amount of principal and interest falling due in any year on the Bonds will never exceed 75% of the revenues of the Tax estimated to be received by the Issuer in the year in which the Bonds are issued; and             WHEREAS, other than the Bonds herein authorized, the Issuer has no outstanding bonds or other obligations of any kind or nature payable from or enjoying a lien on the Tax herein pledged; and             WHEREAS, it is the desire of the Issuer to fix the details necessary with respect to the issuance of the Bonds and…
