PROCEEDINGS OF THE MEETING OF THE MAYOR AND BOARD OF ALDERMEN OF THE CITY OF BREAUX BRIDGE HELD AT CITY HALL, 101 BERARD STREET, AT 6:00 P.M. ON TUESDAY, MARCH 12, 2024.

Mayor Ricky Calais called the meeting to order, the invocation and the Pledge of Allegiance were recited.

Monthly budget-to-actual comparisons on the General Funds, Sales Tax Funds, Park and Recreation Fund and Utility Funds were distributed to the councilmen and Mayor.

Present:  Ryan Breaux, Scotty Borel, Albert Menard, Neil Melancon and Eddy Leblanc.

Absent:  None

Upon motion of Albert Menard, duly seconded by Eddy Leblanc, and unanimously carried the minutes of the February 14, 2024, Mayor and Board of Aldermen meeting was approved.

Upon motion of Albert Menard, duly seconded by Ryan Breaux and unanimously carried, the Board of Aldermen adopted a Resolution pertaining to the Municipal Water Pollution Prevention Environmental Audit for 2024.

RESOLUTION

CITY OF BREAUX BRIDGE

MUNICIPAL WATER POLLUTION PREVENTION

BE IT RESOLVED that the City of Breaux Bridge informs Louisiana Department of Environmental Quality that the following actions were taken by the Mayor and Board of Aldermen:

1.            Reviewed the Municipal Water Pollution Prevention Environmental Audit Report, which is attached to this Resolution.

On roll call, the above Resolution was adopted as follows:

Upon motion of Albert Menard, duly seconded by Scotty Borel and unanimously carried, the Board of Aldermen introduced Ordinance #2296 (An ordinance to amend Chapter 23 of the Code of Ordinances, the Zoning Ordinance, by the repeal, amendment, revision, enactment, and/ or re-enactment of Section 23-5.5 regarding zoning regulations applicable to R-4 concerning mobile homes, and matters related thereto.)

Upon motion of Albert Menard, duly seconded by Ryan Breaux and unanimously carried, the Board of Aldermen authorized Chief of Police Albert Leblanc to hire 2 full time Patrol Officers as listed below:

Terrell Joseph Bergeron

Jarrad Miles Mouton

Upon motion of Albert Menard, duly seconded by Scotty Borel and unanimously carried, the Board of Aldermen authorized Mayor Ricky Calais and City Attorney Bart Hebert to finalize a Tower lease agreement with AT & T requiring a certain type of structure that the Board agreed to and also applies to the Land and Option Lease agreement the City Attorney just revised.

Upon motion of Ryan Breaux, duly seconded by Albert Menard and unanimously carried, the Board of Aldermen authorized Mayor Ricky Calais to purchase a drainage servitude for the Armentine Cove Outfall Canal for the appraised value.

                CITY OF BREAUX BRIDGE

A RESOLUTION AUTHORIZING THE PURCHASE OF DRAINAGE SERVITUDE FOR ARMENTINE COVE OUTFALL CANAL FOR APPRAISED VALUE

WHEREAS, the members of the Board of Aldermen of the City of Breaux Bridge, previously determined that the construction of the Armentine Cove Outfall Canal and the acquisition of the accompanying permanent servitude of drainage on the property more particularly described as follows is necessary for the public interest, to wit:

The 15-foot strip of land located adjacent to and contiguous with the existing drainage servitude located on the Northwestern 5 feet of that certain parcel of ground being known and designated as Lot 55 of Armentine Cove Subdivision on that certain plat of survey dated December 20, 2002, prepared by Charles W. “Bill” McLeod attached to act recorded under Entry Number 370932 of the records of the St. Martin Parish Clerk of Court’s Office.

Also shown as “PROPOSED 15’ DRAINAGE SERVITUE” on Map Showing Utility Servitudes To Be Acquired By The City of Breaux Bridge, LA from Jessie & Anastasia Knecht prepared by Devon C. Richard, dated November, 2020, a copy of which is attached hereto, located in Section 40, Township 9 South, Range 5 East, City of Breaux Bridge, St. Martin Parish, Louisiana (the “Property”);

WHEREAS, the members of the Board of Aldermen of the City of Breaux Bridge, previously empowered, authorized and directed Mayor Ricky Calais to engage the services of a licensed real estate appraiser to determine the value of the proposed servitude of drainage to be obtained by purchase or by expropriation;

WHEREAS, the Appraisal dated October 31, 2023 and prepared by Michael T. Cope, a Licensed Louisiana Certified General Real Estate Appraiser, established that the total estimated just compensation to the full extent of the owner’s loss for the acquisition of a permanent servitude of drainage on the Property is $11,010.00;

WHEREAS,on this 12th day of March, 2024, the Board of Aldermen of the City of Breaux Bridge, Louisiana, did meet in open and regular session in order to consider this Resolution;

NOW, THEREFORE, IT BE RESOLVED that, We, the Board of Alderman of the City of Breaux Bridge, acting as the governing authority for the said City of Breaux Bridge, hereby declare that the above-described permanent servitude of drainage on the Property should be purchased from the owners of the Property for the amount of $11,010.00.

NOW, THEREFORE, IT BE FURTHER RESOLVED that Mayor Ricky Calais be and he is hereby empowered, authorized and directed to offer to purchase from the owners of the Property for the amount of $11,010.00, and execute any and all acts necessary to acquire same, on behalf of the City of Breaux Bridge the above-described permanent servitude of drainage on the Property that is necessary for the construction and maintenance of the Armentine Cove Outfall Canal;

This Resolution shall become effective immediately upon its adoption.

By motion of Aldermen Ryan  Breaux, duly seconded by Aldermen Albert Menard, the above Resolution was adopted by the following vote on this 12th day of March, 2024:

NAYS: None

ABSENT: None

                                                                                    AND THIS RESOLUTION was declared adopted as of the 12th day of March, 2024.
