PROCEEDINGS OF THE MEETING OF THE MAYOR AND BOARD OF ALDERMEN OF THE CITY OF BREAUX BRIDGE HELD AT THE CITY HALL, 101 BERARD STREET, AT 6:00 P.M. ON TUESDAY, MAY 12,2026
Mayor Ricky Calais called the meeting to order; the Invocation and the Pledge of Allegiance were recited.
Monthly budget-to-actual comparisons on the General Funds, Sales Tax Funds, Park and Recreation Funds, and Utility Funds were distributed to the councilmen and Mayor.
Present: Ryan Breaux, Scotty Borel, Neil Melancon, Albert Menard, and Eddy Leblanc
Upon motion of Albert Menard, duly seconded by Scotty Borel and unanimously carried, a resolution supporting application to AMPO for Poydras Street sidewalks was added as Item #15 to the agenda.
Upon motion of Albert Menard, duly seconded by Ryan Breaux and unanimously carried, open bids for surplus equipment advertised April 22, 2026 was added as Item #16 to the agenda.
Upon motion of Albert Menard, duly seconded by Neil Melancon and unanimously carried, the minutes of the April 14, 2026 council meeting were approved.
Upon motion of Albert Menard, duly seconded by Neil Melancon and unanimously carried the council moved to go into executive session.
Upon motion of Albert Menard, duly seconded by Neil Melancon and unanimously carried, the council moved to come out of executive session.
Chester Cedars gave an update on the litigation with RaceTrac appeal lodged by the owners and informed that the city had prevailed on every previous matter and advised the matter would be argued before the 3rd Circuit Court of Appeals, and that he felt the city has strong legal standing.
Upon motion of Albert Menard, duly seconded by Ryan Breaux and unanimously carried, the following resolution was adopted:
Resolution of Acceptance
A RESOLUTION AUTHORIZING AND DIRECTING THE MAYOR TO EXECUTE FOR AND ON BEHALF OF THE CITY OF BREAUX BRIDGE OF THE PARISH OF ST. MARTIN, LOUISIANA, AN ACT OF ACCEPTANCE FROM NCMC, LLC CONTRACTOR, PERTAINING TO THE COMPLETION OF A CONTRACT FOR THE FILTER REHABILITATION AT THE BREAUX BRIDGE WATER TREATMENT PLANT
Whereas, NCMC, L.L.C., as Contractor, has substantially completed the Filter Rehabilitation Project, for the City of Breaux Bridge, Louisiana, as of May 5, 2026, in accordance with the plans and specifications contained in the Contract Documents pertaining thereto, with the exceptions noted on the list of deficiencies attached hereto; and
Whereas, the City of Breaux Bridge, Louisiana desired to accept the work as being substantially complete, subject to the correction within the lien period of the listed deficiencies;
Now, therefore, it be resolved by the City of Breaux Bridge, of the Parish of St. Martin, Louisiana, that the Mayor of the said City of Breaux Bridge be and is hereby empowered, authorized and directed to execute an Act of Substantial Completion, accepting the work as being substantially complete and that the Mayor be authorized and directed to have a copy of said Notice of Substantial Completion recorded in the Conveyance Records of the Parish of St. Martin, State of Louisiana.
The foregoing resolution was offered by Albert Menard and seconded by Ryan Breaux.
This resolution having been submitted to a vote, the vote thereon was as follows:

Upon motion of Albert Menard, duly seconded by Ryan Breaux and unanimously carried the public hearing on Ordinance # 2323(An Ordinance to declare vacant lot located at 329 Berard Street, Breaux Bridge, Louisiana 70517 not needed for any public purpose and to dispose of such property by private sale to Jerry Hale for $2000.00 (appraised price), and matters related thereto) was opened.
Mayor Calais explained the small section of the property located at the corner of Dorset and Berard Street purchased by the city to widen the road and property owner Jerry Hale was the adjacent property owner to the property purchased and advised the council the city had no use for the property.
Upon motion of Albert Menard, duly seconded by Eddy LeBlanc and unanimously carried there being no public input, the hearing was closed.
Upon motion of Albert Menard, duly seconded by Scotty Borel and unanimously carried Ordinance #2323 was adopted.
ORDINANCE NO. 2323
Ordinance to declare vacant lot located at 329 Berard Street, Breaux Bridge, Louisiana 70517 not needed for any public purpose and to dispose of such property by private sale to Jerry Hale for the sum of $2,000.00, the appraised fair market value of such property, and matters related thereto.
WHEREAS, the City of Breaux Bridge (the “City”) purchased the property located at 329 Berard Street, Breaux Bridge, Louisiana 70517 (the “Property”) for the purpose widening of Dorset Street (the “Project”);
WHEREAS, the Project did not require use of the entirety of the Property, and the unused portion of the Property remainingafter the Project (the “Lot”) is not needed for any public purpose by the City;
WHEREAS, the City obtained an appraisal of the Lot by Ransel Real Estate Appraisals dated September 17, 2025 whereby the fair market value of the Lot was determined to be the sum of Two Thousand and No/100 ($2,000.00) Dollars (the “Appraised Value”);
WHEREAS, Jerry Hale owns land adjacent to the Lot and has agreed to purchase the Lot from the City for the Appraised Value;
WHEREAS, Louisiana R.S. 33:4712 authorizes a municipality to dispose of any property not needed for a public purpose; and the Mayor and the Board of Aldermen have determined that the Lot is no longer serves any public purpose;
WHEREAS, pursuant to La. R.S. 33:4712 B, before the City may sell public property to private persons, it must declare that the property is no longer needed for a public purpose, and an ordinance must be introduced, giving the reasons for the action on the part of the governing authority, and fixing the minimum price and terms of the sale to be made with reference to the property, and notice of the proposed ordinance must be published three times in fifteen days, one week apart, in a newspaper published having a general circulation in the municipality;
WHEREAS, pursuant to La. R.S. 33:4712 C, any opposition to the proposed ordinance shall be made in writing, filed with the clerk or secretary of the municipality within fifteen days after posting of the above notice or its first publication; and if an opposition is filed, the governing authority shall not adopt the ordinance until a hearing has been held. If the ordinance is adopted, it shall not become effective until ten days after its passage, during which time any interested citizen may apply to the district court having jurisdiction of the municipality for an order restraining the disposition of the property. After the ordinance becomes effective, it cannot be contested for any reason;
WHEREAS, the City desires to sell the Lot to a Jerry Hale for the Appraised Value under the terms set forth hereunder in this Ordinance;
BE IT ORDAINED by the Board of Aldermen for the City of Breaux Bridge,Louisiana, duly convened in regular session on the 12th day of May, 2026, that the City of Breaux Bridge, Louisiana, did declare that the following described property is no longer needed for any public purpose:
That certain lot or parcel of ground, together with all buildings and improvements thereon, situated in Section 107, Township 9 South, Range 6 East, St. Martin Parish, Louisiana, consisting of 0.263 acre, more or less, and being known and designated as “SUBJECT LOT 0.263 ACRE” on that certain Plat of Survey dated September 5, 2025 by Blake Belaire, PLS No. 5368,a copy of which is attached hereto and made a part hereof; and having such dimensions, boundaries, shape, form, location and configuration as shown on the said Plat of Survey.
Being property currently owned by the City located at 329 Berard Street, Breaux Bridge, Louisiana 70517, less and except that portion of said property dedicated for public use as part of Dorset Street being identified as “Area to be retained for Right of Way-0.067 Ac.” on the aforesaid Plat of Survey, and all servitudes of drainage or passage associated therewith.

BE IT FURTHER ORDAINED by the Board of Aldermen for the City of Breaux Bridge,Louisiana, that the City of Breaux Bridge, Louisiana, after all proper notices, publications, time delays and hearings, if applicable, are had, in compliance with La. R.S. 33:4712, that the City sell the Lot to Jerry Hale, for the sum of $2,000.00, in cash.
BE IT FURTHER ORDAINED that in accordance with Louisiana R.S. 33:4712 (B), notice of this proposed Ordinance shall be published three (3) times in fifteen (15) days, one week apart, in a newspaper having a general circulation in the City.
BE IT FURTHER ORDAINED that any opposition to this proposed Ordinance shall be made in writing, filed with the Clerk of the City of Breaux Bridge within fifteen (15) days after the first publication of the aforementioned notice.
BE IT FURTHER ORDAINED thatif any opposition to this proposed Ordinance is timely and properly filed, the City shall not adopt this Ordinance until a hearing has been held; and further, this Ordinance shall not become effective until all delays and requirements of law are satisfied.
BE IT FURTHER ORDAINED that this Ordinance, if adopted, and in accordance with Louisiana R.S. 33:4712 (C), shall become effective ten (10) days after the signature of the Mayor and Clerk of the City of Breaux Bridge, Louisiana.
BE IT FURTHER ORDAINED that once this Ordinance becomes effective, the Mayor for the City of Breaux Bridge, Louisiana, be and is hereby authorized, directed, and empowered to enter into any and all contracts and execute any and all documents which may be necessary to effectuate the above and foregoing sale and edicts.
BE IT FURTHER ORDAINED by the Board of Aldermen for the City of Breaux Bridge, Louisiana, that all other ordinances and provisions of the Code of Ordinances for the City of Breaux Bridge, Louisiana, that are in conflict with the provisions hereof are hereby declared to be repealed to the extent any such conflict exists.
BE IT FURTHER ORDAINED by the Board of Aldermen for the City of Breaux Bridge, Louisiana, that the provisions of this ordinance are hereby declared to be severable, and if any provision, word, phrase, or clause of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect the validity of the remaining portions thereof.
BE IT FURTHER ORDAINED by the Board of Alderman for the City of Breaux Bridge, Louisiana, duly convened in regular session on the 12th day of May, 2026, that this ordinance shall become effective upon signature of the Mayor and Clerk of the City of Breaux Bridge, Louisiana, the lapse of ten (10) days after receipt by the Mayor of the City of Breaux Bridge, Louisiana without signature or veto, or upon an override of a veto, whichever occurs first.

- Introduced on March 10, 2026 at the regular meeting of the Mayor and Board of Alderman for the City of Breaux Bridge, Louisiana;

- Published, by title, in the official journal of the City of Breaux Bridge, Louisiana, together with the notice of the time and place of its consideration for formal adoption on April 22, 2026, April 29, 2026 and May 6, 2026; and
- Presented at a public hearing held on the 12th day of May, 2026,

Upon motion of Albert Menard, duly seconded by Neil Melancon and unanimously carried the council approved the recommendation of Chief LeBlanc to hire Brandon Gauthreaux as Patrol Officer with the Breaux Bridge Police Department.
Upon motion of Eddy LeBlanc, duly seconded by Ryan Breaux and unanimously carried, Ordinance #2326(An ordinance approving and adopting an Amendment to the Master Plan to include the following projects: (1) Sewer and water system repairs; (2) Engineering and construction costs associated with the Mills Avenue and Champagne Blvd extension projects: (3) Access road improvements and/or construction regarding property development along I-10, to be funded through the use of tax proceeds generated by the special tax imposed by Sales Tax District No. 1 of the City of Breaux Bridge, State of Louisiana, and providing for other matters in connection therewith) was introduced for public hearing to be held at the June 9, 2026 council meeting.

RESOLUTION
A RESOLUTION SUPPORTING THE CITY OF BREAUX BRIDGE APPLICATION TO THE ACADIANA METROPOLITAN PLANNING ORGANIZATION / DOTD
REGARDING THE POYDRAS STREET SIDEWALK IMPROVEMENTS PROJECT
WHEREAS, Poydras Street is a major route for pedestrian traffic within the City limits of the City; and
WHEREAS, the sidewalks along Poydras Street from E. Bridge Street to Hollier Road would benefit from upgrading to ADA standards; and
WHEREAS, the City of Breaux Bridge is eligible to apply to the Acadiana Planning Commission and Lafayette MPO for Federal funding under the Federal Pavement Preservation Program
WHEREAS, the City agrees to assume full responsibility for the required match, for design and construction engineering and inspection, for managing and maintaining the project, and for legal liability incurred because of the project; and
WHEREAS, on this 12th day of May, 2026, the Board of Aldermen of the City of Breaux Bridge, Louisiana, did meet in open and regular session in order to consider this Resolution; and
NOW THEREFORE BE IT RESOLVED that the Board of Aldermen of the City of Breaux Bridge authorizes and directs Mayor Ricky J. Calais to request the assistance of and funding from the Acadiana Metropolitan Planning organization and the Louisiana Department of Transportation and Development in support of the improvements to sidewalks along Poydras Street from E. Bridge Street to Hollier Road.
This Resolution shall become effective immediately upon its adoption.
