Mayor Ricky Calais called the meeting to order, the invocation and the Pledge of Allegiance were recited.
Monthly budget-to-actual comparisons on the General Funds, Sales Tax Funds, Park and Recreation Fund and Utility Funds were distributed to the councilmen and Mayor.
Upon motion of Albert Menard, duly seconded by Scotty Borel, and unanimously carried, the Board of Aldermen approved the following addition to the May Meeting Agenda:
Item #19 : Approve or deny authorizing Mayor Calais to accept and sign amended plat for Parc Ridge Subdivision, Phase III.
Present: Scotty Borel, Albert Menard, Neil Melancon and Eddy Leblanc.
Absent: Ryan Breaux
Upon motion of Albert Menard, duly seconded by Neil Melancon, and unanimously carried the minutes of the April 9, 2024 meeting of the Mayor and Board of Aldermen were approved.
Upon motion of Albert Menard, duly seconded by Eddy Leblanc, and unanimously carried, the Board of Aldermen adopted a Resolution and Notice of Acceptance with CO-D Construction for the Visitor’s Center Teche Erosion Control Project.
Resolution of Acceptance
A resolution authorizing and directing the Mayor to execute for and on behalf of the City of Breaux Bridge, Louisiana an Act of Acceptance from CO-D Construction of Louisiana, LLC, of St. Martinville, LA, Contractor, pertaining to the completion of the Visitor’s Center Teche Erosion Control Project for the City of Breaux Bridge, LA.
Whereas, CO-D Construction of Louisiana, LLC., as Contractor, has substantially completed the Visitor’s Center Teche Erosion Control Project for the City of Breaux Bridge, Louisiana, in accordance with the plans and specifications contained in the Contract Documents pertaining thereto; and
Whereas, the City of Breaux Bridge, Louisiana acting through its Mayor and Councilmen, desires to accept the completed work;
Now, therefore, it be resolved by the Councilmen of the City of Breaux Bridge, Louisiana, acting as the governing authority for the said City of Breaux Bridge, that the Mayor, be and he is hereby empowered, authorized and directed to execute an Act of Acceptance for and on behalf of the City of Breaux Bridge, Louisiana, accepting the work as being complete, and that he be authorized and directed to have a copy of said Acceptance recorded in the Conveyance Records of the Parish of St. Martin, State of Louisiana.

Upon motion of Albert Menard, duly seconded by Neil Melancon, and unanimously carried, the Board of Aldermen approved that the policies and procedures manual be modified as required by state.
Upon motion of Albert Menard, duly seconded by Scotty Borel, and unanimously carried, the Board of Aldermen approved the request of Chief LeBlanc to fund the registration of three motorcycles.
Upon motion of Albert Menard, duly seconded by Eddy Leblanc, and unanimously carried, the Board of Aldermen approved a Resolution to authorize Mayor Calais to move forward with legal action on behalf of City and against owners of Lot 55 of Armentine Cove Subdivision for expropriation of drainage servitude for Armentine Cove Drainage Outfall Project.
Upon motion of Albert Menard, duly seconded by Scotty Borel, and unanimously carried, the Board of Aldermen opened a public hearing for Ordinance 2296 (An ordinance to amend Chapter 23 of the Code of Ordinances, the Zoning Ordinance, by the repeal, amendment, revision, enactment, and/or re-enactment of Section 23-5.5 and 23-5.18.3 regarding zoning regulations applicable to R-4 concerning mobile homes, installation standards for mobile homes and matters related thereto.)
Planning and zoning director, Jeremy Broussard explained the changes that were being made to this ordinance. One of the changes is to include the words “mobile home,” which was left out of the ordinance due to an oversight. The second change was making the maximum age of allowed mobile homes to be 10 years.
Upon motion of Eddy LeBlanc, duly seconded by Albert Menard, and unanimously carried, there being no public input the public hearing on Ordinance #2296 was closed.

ORDINANCE NUMBER 2296
An ordinance to amend Chapter 23 of the Code of Ordinances, the Zoning Ordinance, by the repeal, amendment, revision, enactment, and/or re-enactment of Sections 23-5.5 and 23-5.18.3 regarding zoning regulations applicable to R-4 concerning mobile homes, installation standards for mobile homes, and matters related thereto.
BE IT ORDAINED by the Mayor and Board of Alderman for the City of Breaux Bridge, Louisiana duly convened in regular session on the 14th day of May, 2024, that:
The Code of Ordinances for the City of Breaux Bridge, Louisiana be amended by the repeal, amendment, revision, enactment, and/or re-enactment of Sections 23-5.5 and 23-5.18.3 as follows:
Sec. 23-5.5. – R-4, Single family residential, mobile homes.
Permitted uses: Single family dwellings, churches and temples, public and private schools (this includes public and private nursery schools and kindergartens but does not include trade and business schools), parks and playgrounds, private recreational uses, libraries and museums, private gardens, plant nurseries, home occupation and accessory uses. Additionally, Manufactured homes and Modular homes, as such terms are defined in Section 23-5.18.2, and in accordance with such standards and requirements otherwise set forth in the City’s ordinances, shall be permitted in this zoning district.
Minimum lot area: Four thousand square feet per family.
Minimum yards: Front depth 15 feet set back line from street right-of-way. Front width 40 feet. Side yard with minimum per side five feet. Rear yard 20 percent of lot depth not required to exceed 25 feet.
These restrictions do not apply to mobile homes situated in a recognized mobile home park.
Sec. 23-5.18.3. – Maximum age standards; inspection and fee for a used mobile home.
No mobile home that was manufactured in a year more than 10 years prior to the year in which the mobile home is to be situated within the City of Breaux Bridge shall be permitted within the City of Breaux Bridge for any reason whatsoever.
No mobile home manufactured in a year prior to the year in which the mobile home is to be situated within the City of Breaux Bridge, shall be permitted within the City of Breaux Bridge unless and until said mobile home is inspected by the city building inspector and the city building inspector issues a certificate of compliance that the mobile home meets all applicable compliance and building codes regulations. Upon issuance of such certificate of compliance, the mobile home may be delivered to a properly zoned lot within the city limits of Breaux Bridge.
Inspection fees are based on travel distances and are determined by the city building inspector. The inspection fee will be a minimum of $50.00 and a maximum of $150.00 that shall be paid prior to inspection.
BE IT FURTHER ORDAINED by the Board of Aldermen for the City of Breaux Bridge, Louisiana, that all other ordinances and provisions of the Code of Ordinances for the City of Breaux Bridge, Louisiana, that are in conflict with the provisions hereof are hereby declared to be repealed to the extent any such conflict exists.
BE IT FURTHER ORDAINED by the Board of Aldermen for the City of Breaux Bridge, Louisiana, that the provisions of this ordinance are hereby declared to be severable, and if any provision, word, phrase, or clause of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect the validity of the remaining portions thereof.
BE IT FURTHER ORDAINED by the Board of Alderman for the City of Breaux Bridge, Louisiana, duly convened in regular session on the 14th day of May, 2024, that this ordinance shall become effective upon signature of the Mayor of the City of Breaux Bridge, Louisiana, the lapse of ten (10) days after receipt of the Mayor of the City of Breaux Bridge, Louisiana without signature or veto, or upon an override of a veto, whichever occurs first.

Upon motion of Albert Menard, duly seconded by Scotty Borel, and unanimously carried, the Board of Aldermen opened a public hearing for Ordinance #2297 (An Ordinance to rezone to a C-2 Zoning District, as described in Chapter 23 of the Code of Ordinances, the Zoning Ordinance, at Sec. 23-5.11, the portions of the following lots, only to the extent located within a R-1 Zoning District prior to the adoption of this ordinance, which lots are identified by the St. Martin Parish Assessor as Parcel ID Nos. 0690003142, 0690003043, 0690003543, 06901D1665 and 0690003137, all of which are located within the corporate limits of the City of Breaux Bridge; and further to amend the official zoning map of the City of Breaux Bridge, as provided for in Sec. 23-3.3, to reflect same; and matters related thereto and in furtherance thereof).
Planning and zoning director, Jeremy Broussard explained that the purpose of this Ordinance is to rezone the area around Parc Hardy from R-1 to C-2. He said that the R-1 designation would be more appropriate for a neighborhood park. Another reason for this rezone is to allow the cell tower recently approved by the Council to be able to be installed.
The area to be rezoned also includes the property where the City plans to extend Mills Avenue to Champagne Boulevard. The C-3 designation would allow for this extension.
Councilman Melancon asked if the C-3 zone would accommodate municipal or civic structures.
Mr. Broussard stated that as the zoning ordinance currently stands, there are no designated zones for municipal or civic structures.

Upon motion of Albert Menard, duly seconded by Eddy Leblanc, and unanimously carried, the Board of Aldermen opened a public hearing for Ordinance #2298 (An Ordinance to amend Chapter 6 of the Code of Ordinances by the repeal, amendment, revision; enactment, and/or re-enactment of Sections 6 -16, 6-20, 6-25, 6-26, 6-27, 6-28, 6-29, 6-51, 6-81, 6-82, 6-101, 6-121 and 6-129 regarding buildings and building regulations and matters related thereto).
Planning and zoning director, Jeremy Broussard explained that this ordinance pertains to building codes and inspections.
City Attorney, Bart Hebert explained that this ordinance would allow the City to be able to follow the state guidelines regarding building codes without having to change them each time the state made new requirements and regulations. The City would always be up to date with the current state standards.
Mr. Broussard stated that this ordinance would also implement the fee schedule for such services.
Councilman Melancon asked if “Registration Fees” were the same as “Occupational Licenses.” Mr. Broussard answered that no, they were different fees. If a company is located outside of the City limits, the City cannot enforce having them get an occupational license. The City can, however, require a registration fee to do work within the City, which would allow the City to verify that a contractor is properly licensed and insured.
Councilman Melancon asked if the City had anything in place to hold accountable contractors that do not do quality work.
City Attorney, Bart Hebert replied that the City can only verify whether or not the contractor is properly licenses and insured.
Mr. Broussard stated that if complaints would come to the City, he could pass them along to State Board of further action, if necessary.

The Code of Ordinances for the City of Breaux Bridge, Louisiana be amended by the repeal, amendment, revision, enactment, and/or re-enactment of Sections 6-16, 6-20, 6-25, 6-26, 6-27, 6-28, 6-29, 6-51, 6-81, 6-82, 6-101, 6-121 and 6-129 concerning buildings and building regulations and matters related thereto as follows:
Sec. 6-16. – Adoption of Louisiana State Uniform Construction Code.
The Board of Aldermen hereby amends Chapter 6 of the Code of Ordinances to implement each of the most currently adopted codes, along with any amendments thereto; also included is the adoption of each code’s chapter 1, Scope and Administration, in accordance with the provisions of R.S. 40:1730.26 and R.S. 40: 1730.28, relative to the authority of the Louisiana State Uniform Construction Code Council (LSUCCC) and as promulgated and enforced according with R.S. 49:953(B), by the Administrative Procedure Act, the department of public safety and corrections, office of the state fire marshal, and Louisiana State Uniform Construction Code Council (LSUCCC); and to further provide that hereafter the then most current versions of said codes shall be incorporated into the City’s Code of Ordinances through amendment of same, without the necessity of further action on the part of the Board of Aldermen or the City administration, upon the then most current version of each said code being adopted and promulgated by the official body or agency responsible for same. Those codes at issue, which are the subject of, and are affected by, this ordinance, are listed herein below:

Sec. 6-20. – Permits and fees.
(a) Applicable fees shall be imposed and collected by the duly designated agent of the city prior to the issuance of any building permit. In connection therewith, any applicant for a building permit shall, contemporaneously with the application, present to the said agent plans, specifications, and/or blueprints setting in precise numbers the total square footage of the proposed building. The building permit fees required shall be those established by the Mayor and Board of Aldermen, as the same may be amended from time to time.
(b) All outbuildings such as unattached garages, workshops, sheds, pool houses, and the like shall be permitted on a square footage basis and fees required shall be in accordance with those established by the Mayor and Board of Aldermen, as the same may be amended from time to time. Furthermore, all towers, pylon signs, and related structures shall be permitted in accordance with the fees established by the Mayor and Board of Aldermen for same, as the same may be amended from time to time.
(c) All electrical hookup costs and any transfer of electrical services from one person or firm to another shall be charged at the rates established for same by the Mayor and Board of Aldermen, as the same may be amended from time to time.
(d) In the event that any person, firm, or juridical entity commences any construction activities for which a permit and the payment of fees is required, then any permit fee due shall be double the amount which would otherwise be due under the provisions of this chapter.

Sec. 6-25. – Construction Contractor – Registration – Required; fee.
Any person desiring to engage in the business of residential or commercial construction in the city shall, before doing so, register its business with the city and pay the Registration fee which shall be in accordance with those established by the Mayor and Board of Aldermen, as the same may be amended from time to time, and which shall be paid into the city treasury before such registration shall become effective.
Sec. 6-26. – Same—Qualifications.
No registration required by this section shall be issued until the applicant for same has given satisfactory evidence to the building inspector of his ability to do the construction work in a safe and satisfactory manner. No permit for construction, renovation, or improvement, shall be issued until the registration and fees required have been obtained by the city.
Sec. 6-27. – Insurance certification.
Every person engaging in the construction business as a contractor in the city shall execute and deliver to the city a certificate of insurance from a reputable insurer authorized to do and doing business in Louisiana, in order to protect the city against all losses or damages occasioned by the negligence of the principal therein failing to properly execute and protect all work done by him or under his supervision, in any way whatsoever, and further conditioned to observe and keep all ordinances at any time enacted by the city relating to construction work. The said certificate shall set forth proof of liability insurance in an amount not less than $100,000.00. Further, the certificate of insurance must be approved by the mayor and shall be for a period of not less than one year. As such, no contractor or other person shall engage in any construction endeavors whatsoever within the city unless and until he has provided the certificate of insurance as set forth herein.
Sec. 6-28. – Failure to comply.
Any person who shall fail to correct any defect in his work or to meet the required standards after having been given notice of the unfit condition by the building inspector within a reasonable time, shall be refused any other permit until such defects have been corrected and shall be subject to revocation of his registration for continual defective work or upon conviction for violation of the provisions of this article.
Sec. 6-29. – Annual renewal.
The obligations and fees required as set forth in Secs. 6-25 through 6-27 shall be renewed on an annual basis in order for any contractor to continue to perform construction work within the corporate limits of the city.
Sec. 6-51. – National Electrical Code.
There is hereby adopted by the city for the purpose of establishing rules and regulations for the construction, alteration, removal and maintenance of electric wiring and apparatus, including permits and penalties, that certain electric code known as the National Electrical Code as adopted in Sec. 6-16 of the Code of Ordinances.
Sec. 6-81. – Registration – Required; fee.
Any person desiring to engage in the business of electrical construction or of the installation of wiring and apparatus for electric lights, appliances, heating or power in the city shall, before doing so, register its business with the city and pay the Registration fee which shall be in accordance with those established by the Mayor and Board of Aldermen, as the same may be amended from time to time, and which shall be paid into the city treasury before such registration shall become effective.
Sec. 6-82. – Same—Qualifications.
No registration required by this section shall be issued until the applicant for same has given satisfactory evidence to the electrical inspector of his ability to do the electrical work in a safe and satisfactory manner. No permit for installation or alteration of any wiring, heating devices, motors, appliances and apparatus shall be issued until the registration, fees and bond required by this division have been obtained.
Sec. 6-101. – International Fuel Gas Code.
There is hereby adopted by reference as though fully set out herein that certain code known as the International Fuel Gas Code as adopted in Sec. 6-16 of the Code of Ordinances.
Sec. 6-121. – International Plumbing Code.
There is hereby adopted for the purpose of regulating the installation of all plumbing and to secure the beneficial interest and purpose thereof, which are health, sanitation, general public safety and welfare, that certain code known as the International Plumbing Code as adopted in Sec. 6-16 of the Code of Ordinances.
Sec. 6-129. – Registration required for plumbers and fee therefore.
Each person desiring to engage in the plumbing business in the city shall, before doing so, register its business with the City and shall pay into the city treasury the Registration fee which shall be established by the Mayor and Board of Aldermen, as the same may be amended from time to time, before engaging in the business of plumbing within the corporate limits of the city.
BE IT FURTHER ORDAINED by the Board of Aldermen for the City of Breaux Bridge, Louisiana, that all other ordinances and provisions of the Code of Ordinances for the City of Breaux Bridge, Louisiana, that are in conflict with the provisions hereof are hereby declared to be repealed to the extent any such conflict exists.
BE IT FURTHER ORDAINED by the Board of Aldermen for the City of Breaux Bridge, Louisiana, that the provisions of this ordinance are hereby declared to be severable, and if any provision, word, phrase, or clause of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect the validity of the remaining portions thereof.

Planning and zoning director, Jeremy Broussard explained he has gotten several requests from this area of the City to put or replace mobile homes. Currently, mobile homes are prohibited from being placed in this area. He stated that because much of this area contains mobile homes, it would make sense to zone it accordingly.
A citizen asked if any of the rezone would include commercial zoning. Mr. Broussard stated that only those businesses that are currently operating would be “grandfathered” in and if any of these businesses were to close for 12 months, the zone would revert to residential.

Planning and zoning director, Jeremy Broussard explained that at the Zoning Commission Board meeting held the previous week, the Board voted to table a portion of the Ordinance pertaining to the C-1 district. They did, however, recommend for acceptance the remainder of the Ordinance.
Council Albert Menard expressed his disapproval of their decision and asked if the Board of Aldermen could pass the Ordinance as introduced at the last City Council meeting.
City Attorney, Bart Hebert said that the Council could only accept or reject the Zoning Board’s recommendation, but could not take action on an item on which they did not offer a recommendation.

Sec. 23-5.12. – C-3, Downtown Business District.

Upon motion of Albert Menard, duly seconded by Eddy LeBlanc and unanimously carried, the Board of Aldermen adjourned the meeting.
