PROCEEDINGS OF THE MEETING OF THE MAYOR AND BOARD OF ALDERMEN OF THE CITY OF BREAUX BRIDGE HELD AT CITY HALL, 101 BERARD STREET, AT 6:00 P.M. ON TUESDAY, NOVEMBER 9, 2021.

Mayor Ricky Calais called the meeting to order, the invocation and the Pledge of Allegiance were recited.

Present:  Ryan Breaux, Scotty Borel, Ernest “E.J.” Ledet, Neil Melancon, Eddy LeBlanc

Absent: None

Monthly budget-to-actual comparisons on the General Funds, Sales Tax Funds, Park and Recreation Fund, and Utility Funds were distributed to the councilmen and Mayor.

Upon motion of Neil Melancon, duly seconded by Ryan Breaux, and unanimously carried, the Board of Aldermen approved the deletion of item #13 from the agenda.

            Item #13 – Approve or deny the recommendation of the Zoning Committee to rezone 1  

             lot Parcel ID# 05902D1414 located on Latiolais Drive from Comercial-5 to Residential-3.

Upon motion of Ernest Ledet, duly seconded by Eddy LeBlanc and unanimously carried, the Board of Aldermen approved item #23 to be added to the agenda.

Item #23 – Resolution to pursue the rezoning of the following lots located on Latiolais Drive from Commerical-5 to Residental-3. Parcel ID# 05902C0865, 05902C1163, 05902D1204, 05902D1305, 05902D1105, 05902D1006, 05902D0907, 05902D0808, 05902D1007, 05902D1206, 05902D1107, 05902D0908, 05902D0809, 05902D1210, 05902D1209, 05902D1409, 05902D1508, 05902D1312, 05902D1414, 05902D1515, 05902D1819, 05902D2123, 05902D2326.

Upon motion of Ernest Ledet, duly seconded by Eddy LeBlanc, and unanimously carried, the minutes of the October 6, 2021 City Council meeting were approved.

City Auditor, Russell Champagne of Champagne & Company, gave a brief summary of the city’s financial audit for the fiscal year ending June 30, 2021.

Upon motion of Eddy LeBlanc, duly seconded Scotty Borel, and unanimously carried, the Board of Aldermen adopted a Resolution of Acceptance authorizing and directing Mayor to execute for and on behalf of the City of Breaux Bridge, Louisiana an Act of Acceptance from Pointe Coupee Contractors, LLC of Ventress, La, Contractor, pertaining to the completion of the Martin Street Sidewalk Addition for the City of Breaux Bridge, La.

Resolution of Acceptance

            A resolution authorizing and directing the Mayor to execute for and on behalf of the City of Breaux Bridge, Louisiana an Act of Acceptance from Pointe Coupee Contractors, LLC. of Ventress, LA, Contractor, pertaining to the completion of the Martin Street Sidewalk Addition for the City of Breaux Bridge, LA.

            Whereas, Pointe Coupee Contractors, LLC., as Contractor, has substantially completed the Martin Street Sidewalk Addition for the City of Breaux Bridge, Louisiana, in accordance with the plans and specifications contained in the Contract Documents pertaining thereto; and

            Whereas, the City of Breaux Bridge, Louisiana acting through its Mayor and Councilmen, desires to accept the completed work;

            Now, therefore, it be resolved by the Councilmen of the City of Breaux Bridge, Louisiana, acting as the governing authority for the said City of Breaux Bridge, that the Mayor, be and he is hereby empowered, authorized and directed to execute an Act of Acceptance for and on behalf of the City of Breaux Bridge, Louisiana, accepting the work as being complete, and that he be authorized and directed to have a copy of said Acceptance recorded in the Conveyance Records of the Parish of St. Martin, State of Louisiana.

            The foregoing resolution was offered by Eddy LeBlanc and seconded by Scotty Borel.

This resolution having been submitted to a vote, the vote thereon was as follows:

NOTICE OF ACCEPTANCE

            TO ALL WHOM IT MAY CONCERN, and especially to all subcontractors, workmen, laborers, mechanics, and furnishers of materials:

Public Notice is hereby given according to law that the undersigned Owner has accepted, as substantially complete, the work done on the Martin Street Sidewalk Addition by Pointe Coupee Contractors. LLC, Contractor, under his contract with the City of Breaux Bridge, Louisiana, dated September 8, 2020, and recorded under Book No. 1636, page 754 in the Records of the Clerk of Court, Parish of St. Martin, Louisiana;

            All subcontractors, workmen, laborers, mechanics, and furnishers of materials must assert whatever claim they may have against the said Contractor, growing out of the execution of said Contract, according to law, within 45 days from registration hereof.

Upon motion of Neil Melancon, duly seconded by Ryan Breaux, and unanimously carried, the Board of Aldermen approved a resolution to approve conveyance of tax title interest in property at 746 South Belle Circle to Belaire Development and Construction, LLC for amounts owed, and execution of Act of Conveyance thereof.

Upon motion of Neil Melancon, duly seconded by Ryan Breaux, and unanimously carried, the Board of Aldermen approved the recommendation of the Zoning Committee to rezone 1 lot Parcel ID# 06901I3444 located at 365 Cannery Road from Industrial-1 to Commercial-2.

Upon motion of Scotty Borel, duly seconded by Ernest Ledet, and unanimously carried, the Board of Aldermen approved the recommendation of the Zoning Committee to rezone 1 lot

Parcel ID# 05902D1414 located on Latiolais Drive from Commercial-5 to Residential-3.

Upon motion of Ernest Ledet, duly seconded by Scotty Borel, and unanimously carried, the Board of Aldermen approved the recommendation of the Zoning Committee to rezone 2 lots

Parcel ID# 05902D1819 and 05902D2123 located on Latiolais Drive from Commercial-5 to Residential-3.

Upon motion of Ernest Ledet, duly seconded by Scotty Borel, and unanimously carried, the Board of Aldermen approved the recommendation of the Zoning Committee to rezone 2 lots

Upon motion of Neil Melancon, duly seconded by Ryan Breaux, and unanimously carried, the Board of Aldermen approved the recommendation of the Zoning Committee to rezone 1 lot Parcel ID# 08001C4220 located at 219 W. Bridge Street from Commercial-3/Commercial-4 to Residential-3.

Upon motion of Ryan Breaux, duly seconded by Eddy LeBlanc, and unanimously carried, the Board of Aldermen approved the recommendation of the Zoning Committee to rezone 11 lots of  Parcel ID# 06901G0511, 06901G0815, 06901K4618, 06901K4719, 06901K4821, 06901K4522, 06901K4420, 06901K4121, 06901K4118, 06901K4216 and 06901K4314 located in the Teche Heights Subdivision from Commercial-2 to Residential-1.

Upon motion of Eddy LeBlanc, duly seconded by Ryan Breaux, and unanimously carried, the Board of Aldermen introduced Ordinance #2273 (An Ordinance to amend Chapter 23 of the Code of Ordinances, the Zoning Ordinance, by the repeal, amendment, revision, enactment, and/or re-enactment of Sections 23-3.1, et al. regarding general zoning regulations applicable to all zoning districts, and specific zoning regulations for specific zoning districts, including R-1, R-2, R-3,

 R-4, R-5, R-6, Traditional Neighborhood Development District, C-1, C-2, C-3, C-4, C-5, C-6,

M-1, M-2, M-3, I-1 and I-2, and matters related thereto).

Upon motion of Ryan Breaux, duly seconded by Neil Melancon, and unanimously carried, the Board of Aldermen introduced Ordinance #2274 (An Ordinance to amend Chapter 19 of the Code of Ordinances, Subdivision Regulations, and sections therein, by the repeal, amendment, revision, enactment, and/or re-enactment of Sections 19-1, and following, regarding subdivision regulations, design and construction standards of improvements, maintenance and warranty requirements and regulations, and matters related thereto).

Upon motion of Ryan Breaux, duly seconded by Ernest Ledet, and unanimously carried, the Board of Aldermen approved the hire of one patrol officer, Andrew Bankard.

Upon motion of Eddy LeBlanc, duly seconded by Scotty Borel, and unanimously carried, the Board of Aldermen ordered that the property located at 214 Avon Street be condemned and demolished as recommended by our State Code Inspector.

Upon motion of Ernest Ledet, duly seconded by Ryan Breaux, and unanimously carried, the Board of Aldermen approved the Resolution to pursue the rezoning of the following lots located on Latiolais Drive from Commerical-5 to Residental-3. Parcel ID# 05902C0865, 05902C1163, 05902D1204, 05902D1305, 05902D1105, 05902D1006, 05902D0907, 05902D0808, 05902D1007, 05902D1206, 05902D1107, 05902D0908, 05902D0809, 05902D1210, 05902D1209, 05902D1409, 05902D1508, 05902D1312, 05902D1414, 05902D1515, 05902D1819, 05902D2123, 05902D2326.

Upon motion of Ernest Ledet, duly seconded by Eddy LeBlanc, and unanimously carried, the Board of Aldermen adjourned the meeting.
