PROCEEDINGS OF THE MEETING OF THE MAYOR AND BOARD OF ALDERMEN OF THE CITY OF BREAUX BRIDGE HELD AT THE CITY HALL, 101 BERARD STREET, at 6:00 P.M. ON TUESDAY, JUNE 14, 2022. Mayor Ricky Calais called the meeting to order, the invocation and the Pledge of Allegiance were recited. PRESENT: Ryan Breaux, Scotty Borel, Ernest “E.J.” Ledet, Neil Melancon and Eddy LeBlanc. Absent: None Monthly budget-to-actual comparisons on the General Funds, Sales Tax Funds, Park and Recreation Fund, and Utility Funds were distributed to the councilmen and Mayor. Upon motion of Ryan Breaux, duly seconded by Ernest Ledet, and unanimously carried the minutes of the May 10, 2022, City Council meeting were approved. Upon motion of Eddy LeBlanc, duly seconded by Scotty Borel, and unanimously carried, the Board of Aldermen approved the minutes of a special meeting held on May 27, 2022. Upon motion of Eddy Breaux, duly seconded by Neil Melancon and Eddy LeBlanc, and unanimously carried, the Board of Aldermen approved authorizing Mayor Calais to award the contract for the CWEF 2019 Lime Silo Repainting Project to Southern Coating, LLC of Broussard as the lowest bidder in the amount of $64,183. Upon motion of Eddy LeBlanc, duly seconded by Ernest Ledet and unanimously carried, the Board of Aldermen opened a public hearing for Ordinance #2276 (An ordinance to amend Chapter 23 of the Code of Ordinances, the Zoning Ordinance, by the repeal, amendment, revision, enactment, and/or re-enactment of Sections 23-4.26 and 23-4.27 regarding general zoning regulations applicable to all zoning districts, concerning regulation of buildings and structures, size and location thereof, and restrictions with respect to front yard, rear yard and side yard, and matters related thereto.). Planning and Zoning Director, Jeremy Broussard explained that this Ordinance passed at the Planning and Zoning Commission meeting. The Ordinance outlines setbacks for accessory buildings on residential lots. After discussion with the council, a final decision on what the setbacks should be was decided on and are reflected in the adopted Ordinance below. Upon motion of Ryan Breaux, duly seconded by Eddy LeBlanc and unanimously carried, the Board of Aldermen closed the Public Hearing for Ordinance #2276. Upon motion of Neil Melancon, duly seconded by Ryan Breaux and unanimously carried, the Board of Aldermen adopted Ordinance #2276 (An ordinance to amend Chapter 23 of the Code of Ordinances, the Zoning Ordinance, by the repeal, amendment, revision, enactment, and/or re-enactment of Sections 23-4.26 and 23-4.27 regarding general zoning regulations applicable to all zoning districts, concerning regulation of buildings and structures, size and location thereof, and restrictions with respect to front yard, rear yard and side yard, and matters related thereto.). ORDINANCE NUMBER 2276 An ordinance to amend Chapter 23 of the Code of Ordinances, the Zoning Ordinance, by the repeal, amendment, revision, enactment, and/or re-enactment of Sections 23-4.26 and 23-4.27 regarding general zoning regulations applicable to all zoning districts, concerning regulation of buildings and structures, size and location thereof, and restrictions with respect to front yard, rear yard and side yard, and matters related thereto. BE IT ORDAINED by the Mayor and Board of Alderman for the City of Breaux Bridge, Louisiana duly convened in regular session on the 14th day of June, 2022, that: The Code of Ordinances for the City of Breaux Bridge, Louisiana be amended by the repeal, amendment, revision, enactment, and/or re-enactment of Sections 23-4.26 and 23-4.27 as follows: Sec. 23-4.26. – Accessory building and structures other than fences; distance from lot line. No part of any structure, other than a fence, and no part of any building shall be built less than five (5) feet from any lot line. Additionally, no part of any such structure or accessory building shall be taller than twice the distance such part of the subject structure or accessory building is from any lot line. Sec. 23-4.27. – Accessory building; location. Accessory buildings shall not be built in the front yard or within the area of minimum setback for the side yard, and the front setback for an accessory building shall be no closer to the front lot line than the part of the front of the principal building located furthest from the front lot line. In addition, no accessory building shall be closer than 40’ from to the front lot line. BE IT FURTHER ORDAINED by the Board of Aldermen for the City of Breaux Bridge, Louisiana, that all other ordinances and provisions of the Code of Ordinances for the City of Breaux Bridge, Louisiana, that are in conflict with the provisions hereof are hereby declared to be repealed to the extent any such conflict exists. BE IT FURTHER ORDAINED by the Board of Aldermen for the City of Breaux Bridge, Louisiana, that the provisions of this ordinance are hereby declared to be severable, and if any provision, word, phrase, or clause of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect the validity of the remaining portions thereof. BE IT FURTHER ORDAINED by the Board of Alderman for the City of Breaux Bridge, Louisiana, duly convened in regular session on the 14th day of June, 2022, that this ordinance shall become effective upon signature of the Mayor of the City of Breaux Bridge, Louisiana, the lapse of ten (10) days after receipt of the Mayor of the City of Breaux Bridge, Louisiana without signature or veto, or upon an override of a veto, whichever occurs first. UPON MOTION of Neil Melancon, seconded by Ryan Breaux, and upon verification and assurance that the foregoing ordinance was: 1. Introduced on March 8, 2022, at the regular meeting of the Mayor and Board of Alderman for the City of Breaux Bridge, Louisiana; 2. Disseminated to the Mayor and all Aldermen; 3. Published, by title, in the official journal of the City of Breaux Bridge, Louisiana, together with the notice of the time and place of its consideration for formal adoption; and 4.
