PROCEEDINGS OF THE MEETING OF THE MAYOR AND BOARD OF ALDERMEN OF THE CITY OF BREAUX BRIDGE HELD AT CITY HALL, 101 BERARD STREET, AT 6:00 P.M. ON TUESDAY, MARCH 8, 2022.

Mayor Ricky Calais called the meeting to order, the invocation and the Pledge of Allegiance were recited.

Present:  Ryan Breaux, Scotty Borel, Ernest Ledet, Neil Melancon, Eddy LeBlanc

Absent: None

Monthly budget-to-actual comparisons on the General Funds, Sales Tax Funds, Park and Recreation Fund, and Utility Funds were distributed to the councilmen and Mayor.

Upon motion of Eddy Leblanc, duly seconded by Neil Melancon and unanimously carried, the Board of Aldermen approved the addition of one item and deletion of one item to the agenda, as follows:

            Delete Item #8: Approve or deny the recommendation of Planning & Zoning Commission concerning a proposed ordinance to amend Chapter 23 of the Code of Ordinances, the Zoning Ordinance, by the repeal, amendment, revision, enactment, and/or re-enactment of Sections 23-5.12, 23-5.19.3 , 23-5.19.4 , 23-5.19.10 3.1, et al. regarding zoning regulations applicable to C-3 and C-6 concerning off street parking regulations, and concerning schools, and matters related thereto.

            Add Item #17: Approve the purchase of police Explorer Interceptor for the Marshal’s Office.

Upon motion of Ryan Breaux, duly seconded by Neil Melancon and unanimously carried, the minutes of the February 8, 2022 City Council meeting were approved.

Upon motion of Ryan Breaux, duly seconded by Eddy LeBlanc and unanimously carried, the Board of Aldermen adopted a resolution pertaining to Municipal Water Pollution Prevention.

CITY OF BREAUX BRIDGE

MUNICIPAL WATER POLLUTION PREVENTION

BE IT RESOLVED that the City of Breaux Bridge informs Louisiana Department of Environmental Quality that the following actions were taken by the Mayor and Board of Aldermen:

1.         Reviewed the Municipal Water Pollution Prevention Environmental Audit Report, which is attached to this Resolution.

On roll call, the above Resolution was adopted as follows:

Upon motion of Ryan Breaux, duly seconded by Neil Melancon and unanimously carried, the Board of Aldermen approved the funding of the Bayou Lane Subdivision Drainage Project.

Upon motion of Ryan Breaux, duly seconded by Eddy LeBlanc and unanimously carried, the Board of Aldermen adopted a Resolution and Notice of Acceptance from M.P. Dumesnil Construction Co., LLC pertaining to the completion of the Sewer Extension Project North of I-10.

RESOLUTION OF ACCEPTANCE

A RESOLUTION AUTHORIZING AND DIRECTING THE MAYOR TO EXECUTE FOR AND ON BEHALF OF THE CITY OF BREAUX BRIDGE OF THE PARISH OF ST. MARTIN, LOUISIANA, AN ACT OF ACCEPTANCE FROM M.P. DUMESNIL CONSTRUCTION CO., LLC CONTRACTOR, PERTAINING TO THE COMPLETION OF A CONTRACT FOR THE SEWER EXTENSION NORTH OF I-10

            WHEREAS, M.P. Dumesnil Construction Co., L.L.C., as Contractor, has substantially completed the Sewer Extension North of I-10 Project, for the City of Breaux Bridge, Louisiana, as of February 7, 2022, in accordance with the plans and specifications contained in the Contract Documents pertaining thereto, with the exceptions noted on the list of deficiencies attached hereto; and

            WHEREAS, the City of Breaux Bridge, Louisiana desired to accept the work as being substantially complete, subject to the correction within the lien period of the listed deficiencies;

            NOW, THEREFORE, IT BE RESOLVED by the City of Breaux Bridge, of the Parish of St. Martin, Louisiana, that the Mayor of the said City of Breaux Bridge be and is hereby empowered, authorized and directed to execute an Act of Substantial Completion, accepting the work as being substantially complete and that the Mayor be authorized and directed to have a copy of said Notice of Substantial Completion recorded in the Conveyance Records of the Parish of St. Martin, State of Louisiana.

            The foregoing resolution was offered by Ryan Breaux and seconded by Eddy LeBlanc. 

This resolution having been submitted to a vote, the vote thereon was as follows:

NOTICE OF ACCEPTANCE

            TO ALL WHOM IT MAY CONCERN, and especially to all subcontractors, workmen, laborers, mechanics, and furnishers of materials:

Public Notice is hereby given according to law that the undersigned Owner has accepted, as substantially complete, the work done on the Sewer Extension North of I-10 Project, City of Breaux Bridge by M.P. Dumesnil, Construction Co., L.L.C, Contractor, under its contract with said firm of date November 20, 2019, and recorded as Act No. 532116 in the Mortgage Records of the Parish of St. Martin, Louisiana.

            All subcontractors, workmen, laborers, mechanics, and furnishers of materials must assert whatever claim they may have against the said Contractor, growing out of the execution of said Contract, according to law, within 45 days from registration hereof.

Upon motion of Neil Melancon, duly seconded by Eddy Leblanc and unanimously carried, the Board of Aldermen approved the final plat for Atchafalaya Trace Subdivision Phase II subject to the following requirements: construction of sidewalks outside of the common areas of the subdivision are the only outstanding improvements which must be completed by Applicant within eighteen months of today; submission of a  performance bond for completing sidewalks in the amount of no less than $72,545.55, per City Engineer recommendation; approval of final plat shall be pending final approval by the City’s Attorney of the performance bond submitted.

Upon motion of Neil Melancon, duly seconded by Eddy LeBlanc, and carried, the Board of Aldermen did not follow the recommendation of the Zoning Commission and voted to adopt Ordinance #2275 (An ordinance to amend Chapter 23 of the Code of Ordinances, the Zoning Ordinance, by the repeal, amendment, revision, enactment, and/or re-enactment of Sections 23-5.12, 23-5.19.3, 23-5.19.4, 23-5.19.10, et al.  regarding zoning regulations applicable to C-3 and C-6 concerning off street parking regulations, and concerning churches and schools, and matters related thereto), in the form and content as submitted, subject to the following changes:

            Deletion of the following phrase in Sec. 23-5-19.3. – Permitted Uses.
            “Single family residential is allowable, but not encouraged.”

Deletion of Sec. 23-5-19.4- Prohibited Uses
The Rees Street Enhanced Arterial Commercial Zoning District prohibits light or heavy manufacturing, public works, government services or facilities (except public parks and gateways), storage facilities, distribution centers, light or heavy industrial facilities or services, agriculture, bars/lounges (unless a minor service of a restaurant or “sports bar” as defined for the district), waste transfer facility, shipping container sales, animal kennels, environmental clean-up facilities, re-cycling centers, cemeteries, mobile homes, funeral homes, and nursing homes.

ORDINANCE NUMBER 2275

An ordinance to amend Chapter 23 of the Code of Ordinances, the Zoning Ordinance, by the repeal, amendment, revision, enactment, and/or re-enactment of Sections 23-5.12, 23-5.19.3, 23-5.19.4, 23-5.19.10, et al.  regarding zoning regulations applicable to C-3 and C-6 concerning off street parking regulations, and concerning churches and schools, and matters related thereto.

BE IT ORDAINED by the Mayor and Board of Alderman for the City of Breaux Bridge, Louisiana duly convened in regular session on the 8th day of March, 2022, that:

The Code of Ordinances for the City of Breaux Bridge, Louisiana be amended by the repeal, amendment, revision, enactment, and/or re-enactment of Sections 23-5.12, 23-5.19.3, 23-5.19.4 and 23-5.19.10 as follows:

Sec. 23-5.12. – C-3, Central Business Commercial District.

Permitted uses:  Professional and business offices, retail and wholesale uses, warehouses, storage and public garages, funeral homes, hotels, radio, television stations, private nursery schools and kindergartens, schools and religious centers (churches, temples, synagogues, community centers). 

Minimum lot area: None.

Minimum yards:  Front depth five (5) feet. Front width none. Side yard none, provided the buildings are of fireproof construction and are located on non-through lots. Otherwise, a five (5) foot minimum side yard is required. Rear yards none, provided the buildings are of fireproof constructions and are located on non-through lots. Otherwise, a ten (10) foot minimum rear yard is required.

Sec. 23-5.19.3. – Permitted Uses.

The Rees Street Enhanced Arterial Commercial Zoning District allows for a mix of commercial land uses including medical service, business office, general retail, restaurants, entertainment and athletic centers, equipment sales, fueling stations, food centers, department stores, business services, parking garages, vehicle repair shops, sports bars, plant nursery sales, convenience stores, overnight camping/recreational vehicle parks, personal services, movie theaters, hotels, motels, private nursery schools and kindergartens, schools and religious centers (churches, temples, synagogues, community centers).  The zoning district allows for a select mix of high density residential provided above first floor ground commercial uses.

BE IT FURTHER ORDAINED by the Board of Aldermen for the City of Breaux Bridge, Louisiana, that all other ordinances and provisions of the Code of Ordinances for the City of Breaux Bridge, Louisiana, that are in conflict with the provisions hereof are hereby declared to be repealed to the extent any such conflict exists.

BE IT FURTHER ORDAINED by the Board of Aldermen for the City of Breaux Bridge, Louisiana, that the provisions of this ordinance are hereby declared to be severable, and if any provision, word, phrase, or clause of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect the validity of the remaining portions thereof.

      BE IT FURTHER ORDAINED by the Board of Alderman for the City of Breaux Bridge, Louisiana, duly convened in regular session on the 8th day of March, 2022, that this ordinance shall become effective upon signature of the Mayor of the City of Breaux Bridge, Louisiana, the lapse of ten (10) days after receipt of the Mayor of the City of Breaux Bridge, Louisiana without signature or veto, or upon an override of a veto, whichever occurs first. 

            UPON MOTION of Neil Melancon, seconded by Eddy LeBlanc, and upon verification and assurance that the foregoing ordinance was:

  1. Introduced on February 8, 2022, at the regular meeting of the Mayor and Board of Alderman for the City of Breaux Bridge, Louisiana;
  2. Disseminated to the Mayor and all Aldermen;
  3. Published, by title, in the official journal of the City of Breaux Bridge, Louisiana, together with the notice of the time and place of its consideration for formal adoption; and
  4. Presented at a public hearing held on the 8th day of March, 2022,

The Board of Aldermen, on the 8th day of March, 2022, adopted Ordinance Number 2275 by virtue of the following votes:

Upon motion of Eddy Leblanc, duly seconded by Ernest Ledet and unanimously carried, the Board of Aldermen approved the recommendation of the Zoning Committee to approve the rezoning of 10 lots, Parcel ID#06901B4439, 06901B4045, 06901B3848, 0691B4344, 06901B4642, 06901B4942, 06901B4650, and 05902C0864, located on Latiolais Drive from Commercial-5 to Commercial-2.

Upon motion of Ryan Breaux, duly seconded by Scotty Borel and carried, the Board of Aldermen introduced Ordinance #2276 (An ordinance to amend Chapter 23 of the Code of Ordinances, the Zoning Ordinance, by the repeal, amendment, revision, enactment, and/or re-enactment of Sections 23-4.26 and 23-4.27 regarding general zoning regulations applicable to all zoning districts, concerning regulation of buildings and structures, size and location thereof, and restrictions with respect to front yard, rear yard and side yard, and matters related thereto), with the vote being as follows:

            Yeas: Ryan Breaux, Scotty Borel, Ernest Ledet, Eddy LeBlanc
            Nays: Neil Melancon

Upon motion of Ernest Ledet, duly seconded by by Scotty Borel, and unanimously carried, the Board of Aldermen authorized Chief Cantu to hire Mason Guidry as a patrol officer on the condition that he passes his psychological and physical examinations. 

Upon motion of Eddy LeBlanc, duly seconded by Ryan Breaux and unanimously carried, the Board of Aldermen approved the purchase of a police Explorer Interceptor for the Deputy Marshal.

Upon motion of Ernest Ledet, duly seconded by Scotty Borel and unanimously carried, the Board of Aldermen adjourned the meeting.
