PROCEEDINGS OF THE MEETING OF THE MAYOR AND BOARD OF ALDERMEN OF THE CITY OF BREAUX BRIDGE HELD AT THE CITY HALL, 101 BERARD STREET, AT 6:00 P.M. ON TUESDAY, SEPTEMBER 12, 2023.

Mayor Ricky Calais called the meeting to order, the invocation and the Pledge of Allegiance were recited.

Monthly budget-to-actual comparisons on the General Funds, Sales Tax Funds, Park and Recreation Fund, and Utility Funds were distributed to the councilmen and Mayor.

PRESENT:  Ryan Breaux, Scotty Borel, Albert Menard, Neil Melancon, and Eddy Leblanc.

ABSENT:  None

Upon motion of Neil Melancon, duly seconded by Ryan Breaux and unanimously carried, the Board of Aldermen approved the addition of the following item to the agenda:
            Item #13: Approve recommendation to award the low bidder on sewer pond rehab project to NCMC contingent upon final approval of the funding agency.

Upon motion Albert Menard, duly seconded by Eddy LeBlanc, and unanimously carried, the Board of Aldermen approved the minutes of the August 8, 2023 City Council meeting.

Upon motion of Ryan Breaux, duly seconded by Albert Menard and unanimously carried, the Board of Aldermen opened a public hearing for Ordinance #2291 (Be it ordained by the Board of Aldermen of the City of Breaux Bridge, Louisiana, that the municipal budget for fiscal year ending June 30, 2024 be amended according to the terms and figures contained in the attached exhibit identified as “Exhibit A”.).

Mayor Calais explained the changes that were made either by him or at the request or suggestion of the council and referred to the handout that the Aldermen had received. The changes included increases in the salaries of the Aldermen and City Prosecutor, Marshal’s and Police department budgets to purchase defibrillators, Christmas light budget to replace old and broken decorations. 
The changes also included increases to various projects including the following: Tennis Courts at Parc Hardy, fencing and backstops for Parc Hardy, and increase in repairs and maintenance for the Bridge Street sewer project.

Councilman Melancon requested the following to be added to the budget:
A line item for District D Drainage and Infrastructure for $100,000 and District D Signage and Infrastructure for $100,000.  Councilman Melancon explained that he pursued state funding for projects for his district and therefore wanted those projects to be reflected in the budget.

Council Borel requested that $10,000 be added to the line item for the Summer Recreation Program.

Council LeBlanc requested that the Mayor’s salary be increased by 7%.

Parks and Recreation Director Randy Cormier pointed out that the increase for Parc Hardy fencing that was explained earlier did not include upgrading the backstops.  He gave a quote for the entire project and asked that it also be included. Councilmen Melancon and Breaux spoke in favor of these upgrades.

Councilman Breaux suggested an increase in the Chief’s salary of 3%.

Upon motion of Ryan Breaux, duly seconded by Eddy LeBlanc and unanimously carried, the Board of Aldermen closed the public hearing for Ordinance #2291.

Councilman Albert Menard motioned that all changes be approved and that the aldermen’s salary be increased and that the City Clerk’s salary be increased.  This motioned was seconded by Eddy LeBlanc and unanimously carried, the Board of Aldermen adopted Ordinance #2291 (Be it ordained by the Board of Aldermen of the City of Breaux Bridge, Louisiana, that the municipal budget for fiscal year ending June 30, 2024 be amended according to the terms and figures contained in the attached exhibit identified as “Exhibit A”.).

Upon motion of Albert Menard, duly seconded by Ryan Breaux and unanimously carried, the Board of Aldermen opened a public hearing for Ordinance #2290 (An ordinance to amend Chapter 23 of the Code of Ordinances, the Zoning Ordinance, by the repeal, amendment, revision, enactment, and/or re-enactment of Section 23-5.19.5 regarding C-6 Requirements by changing the requirements of the enhanced street front public servitude from twenty feet to ten feet and matters relating thereto.).

Planning and Zoning Director Jeremy Broussard explained that this ordinance would change the public servitude from twenty feet to ten feet.  Mayor Calais explained that when the Rees Street Corridor was created, this regulation went into effect and has since presented problems for businesses looking to open along Rees Street.

Councilman Melancon stated that this Ordinance would give ten feet of servitude back to the landowner.

Upon motion of Alber Menard, duly seconded by Scotty Borel and unanimously carried, the Board of Aldermen closed the Public Hearing for Ordinance #2290.

ORDINANCE NUMBER 2290

An ordinance to amend Chapter 23 of the Code of Ordinances, the Zoning Ordinance, by the repeal, amendment, revision, enactment, and/or re-enactment of Section 23-5.19.5 regarding C-6 Requirements by changing the requirements of the enhanced street front public servitude from twenty feet to ten feet and matters relating thereto.

BE IT ORDAINED by the Mayor and Board of Alderman for the City of Breaux Bridge, Louisiana duly convened in regular session on the 12th day of September, 2023, that:

The Code of Ordinances for the City of Breaux Bridge, Louisiana be amended by the repeal, amendment, revision, enactment, and/or re-enactment of Section 23-5.19.5 as follows:

Sec. 23-5.19.5.  Requirements.

Rees Street (La. Hwy. 328) public and private infrastructure design and implementation is divided into three area levels of responsibility: (a) Louisiana Department of Transportation and Development (DOTD) for state highway right-of-way infrastructure – roadway, signal lights, roundabouts, curbing, drainage, medians, cross walks, bikeways, pavement, pavement markings, signage and turning lanes; (b) City of Breaux Bridge for street tree landscape, banquette, pedestrian lighting, transit stops, and transportation gateways; and (c) property owner, business owner, or developer for buildings, parking, joint access agreements, community icon, private landscaping, drainage retention, commercial signage, street address display and public servitudes.

(1) The Rees Street Enhanced Arterial Commercial Zoning District applies to property adjacent to the roadway right-of-way for a maximum depth of 800 feet or as noted on the official zoning map for the district.

(2) Minimum Lot Area: None

(3) Enhanced street front public servitude: Ten feet lot depth (from the roadway right-of-way into buildable lot of record) extending width of lot.

(4) Side yard requirements: Seven feet minimum which may be landscaped or hard surfaced.

(5) Rear yard requirements: Seven feet minimum including a vegetative buffer of five feet planted with Hedge Bamboo, Bambusa Multiplex (a non-invasive variety with thick foliage), spacing five feet on center.

(6) City infrastructure: When new development is approved for a buildable lot in the Rees Street Enhanced Arterial Commercial Zoning District, the city will plan to execute provision for installation of, pedestrian lights, banquettes (multipurpose path), and street trees located in the enhanced street front public servitude of the buildable lot. The installation of these improvements shall be in accordance with the Rees Street Advanced Arterial Design Plan adopted cross section.

BE IT FURTHER ORDAINED by the Board of Aldermen for the City of Breaux Bridge, Louisiana, that all other ordinances and provisions of the Code of Ordinances for the City of Breaux Bridge, Louisiana, that are in conflict with the provisions hereof are hereby declared to be repealed to the extent any such conflict exists.

BE IT FURTHER ORDAINED by the Board of Aldermen for the City of Breaux Bridge, Louisiana, that the provisions of this ordinance are hereby declared to be severable, and if any provision, word, phrase, or clause of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect the validity of the remaining portions thereof.

      BE IT FURTHER ORDAINED by the Board of Alderman for the City of Breaux Bridge, Louisiana, duly convened in regular session on the 12th day of September, 2023, that this ordinance shall become effective upon signature of the Mayor of the City of Breaux Bridge, Louisiana, the lapse of ten (10) days after receipt of the Mayor of the City of Breaux Bridge, Louisiana without signature or veto, or upon an override of a veto, whichever occurs first.

            UPON MOTION of Albert Menard, seconded by Eddy LeBlanc, and upon verification and assurance that the foregoing ordinance was:

Upon motion of Albert Menard, duly seconded by Ryan Breaux and unanimously carried, the Board of Aldermen opened a Public Hearing for Ordinance #2289 (An ordinance to amend Chapter 23 of the Code of Ordinances, the Zoning Ordinance, by the repeal, amendment, revision, enactment, and/or re-enactment of Sections 23-5.11 and 23.5.11.1, applicable to all C-2 zoning districts and regarding Class C Package Stores and the sale of alcoholic beverages, and matters related thereto.).

Planning and Zoning Director Jeremy Broussard explained that this was a continuance of a previously passed ordinance which would make the City’s Ordinances be more in line with the state law regarding alcoholic beverages.  It would be amending the C-2 zone to add that if there are any residential districts within 300 feet of a proposed bar, the business owner would have to gain consent of 50% of the households to be permitted to open.

Upon motion of Ryan Breaux, duly seconded by Albert Menard and unanimously carried, the Board of Aldermen closed the Public Hearing for Ordinance #2289.

Upon motion of Ryan Breaux, duly seconded by Eddy LeBlanc and unanimously carried, the Board of Aldermen adopted Ordinance #2289 (An ordinance to amend Chapter 23 of the Code of Ordinances, the Zoning Ordinance, by the repeal, amendment, revision, enactment, and/or re-enactment of Sections 23-5.11 and 23.5.11.1, applicable to all C-2 zoning districts and regarding Class C Package Stores and the sale of alcoholic beverages, and matters related thereto.).

ORDINANCE NUMBER 2289

An ordinance to amend Chapter 23 of the Code of Ordinances, the Zoning Ordinance, by the repeal, amendment, revision, enactment, and/or re-enactment of Sections 23-5.11 and 23.5.11.1, applicable to all C-2 zoning districts and regarding Class C Package Stores and the sale of alcoholic beverages, and matters related thereto.

BE IT ORDAINED by the Mayor and Board of Alderman for the City of Breaux Bridge, Louisiana duly convened in regular session on the 12th day of September, 2023, that:

The Code of Ordinances for the City of Breaux Bridge, Louisiana be amended by the repeal, amendment, revision, enactment, and/or re-enactment of Sections 23-5.11 and 23-5.11.1, as follows:

Sec. 23-5.11 – C -2, Highway commercial district.

Permitted uses: Retail sales and service stores, business and professional offices, restaurants, fueling stations, convenience stores, fix-it shops, personal services shops, laundromats, amusement centers, landscape sales and services, hospitals, clinics, commercial parking, equipment sales and services, grocery centers, recreational vehicle parks, hotels, motels, technology centers (sales and services), pharmacies, private nursery schools and kindergartens, schools, public parks, religious centers (churches, temples, synagogues, community centers), retail storage facilities, and boat/vehicle sales. “Class C Package Stores,” as such term is defined in Sec. 23-5.11.1 below, shall be allowed in this district only to the extent same is permitted in strict compliance with all requirements, and subject to all restrictions, set forth in Sec. 23-5.11.1 below.

Minimum lot area: None.

Minimum yards: Front depth 20 feet. Front width none. Side yard none, provided the buildings are of fireproof construction. Otherwise, a ten (10) foot minimum side yard is required. Rear yard none, provided the buildings are of fireproof construction. Otherwise, a ten (10) foot minimum rear yard is required.

Sec. 23-5.11.1 – Class C Package Store; Definition; Requirements and Restrictions.

  • Class C Package Store, shall have such meaning as defined under Louisiana Revised Statute 26:71.2, as may be amended from time to time.
  • In addition to abiding by all requirements for, and subject to all restrictions against, Class C Package Stores under the City’s ordinances, Louisiana statutes or other applicable law, no Class C Package Store shall be permitted in any C-2 zoning district unless:
  • The lot upon which the Class C Package Store is to be situated is more than 300 feet away from any public playground or of a building used exclusively as a regular church or synagogue, public library, school, or full-time daycare center as defined in La. R.S. 17:405 (A)(4), as may be amended from time to time; and
  • Applicant has obtained the written approval of the location of the Class C Package Store from the owners of more than 50% of the lots that are located within a residential zoning district and within 300 feet of the lot upon which the Applicant seeks to operate a Class C Package Store. If any such residential lot is owned by more than one person or entity, all co-owners of such lot must give their written approval of the location of Class C Package Store in order to be counted as a lot owner giving written approval. 
  • The measurement of the distances set forth in subsection (2) above shall be made by measuring in a straight line from the nearest point of the property line of the lot upon which the Class C Package Store is to be situated, to the nearest point of the property line of any such lot identified under subsection (2).

BE IT FURTHER ORDAINED by the Board of Aldermen for the City of Breaux Bridge, Louisiana, that all other ordinances and provisions of the Code of Ordinances for the City of Breaux Bridge, Louisiana, that are in conflict with the provisions hereof are hereby declared to be repealed to the extent any such conflict exists.

BE IT FURTHER ORDAINED by the Board of Aldermen for the City of Breaux Bridge, Louisiana, that the provisions of this ordinance are hereby declared to be severable, and if any provision, word, phrase, or clause of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect the validity of the remaining portions thereof.

A RESOLUTION CALLING FOR ADOPTION OF THE SYSTEMS SURVEY AND COMPLIANCE QUESTIONNAIRE AS REQUIRED BY THE OFFICE OF THE LEGISLATIVE AUDITOR, STATE OF LOUISIANA.

WHEREAS, The Legislative Auditor, State of Louisiana requires a Systems Survey and Compliance Questionnaire, and;

WHEREAS, Said questionnaire is to be completed and submitted to the Auditing Firm of Champagne and Company, LLC and;

WHEREAS, Said questionnaire must be adopted by a resolution of the Board of Aldermen,

NOW THEREFORE, BE IT RESOLVED, by the Board of Aldermen, of the City of Breaux Bridge, St. Martin Parish, Louisiana duly convened in regular session on this the 12th day of September 2023, that the aforementioned Systems Survey and Compliance Questionnaire is hereby adopted by the City of Breaux Bridge;

BE IF FURTHER RESOLVED THAT, said completed questionnaire and this resolution are forwarded to the auditing firm Champagne and Company, LLC engaged by the City of Breaux Bridge.
